Sentence stands in child rape case

A minimum prison sentence in excess of eight years will stand against a Titusville man who raped an 11-year-old girl.

Adam C. Burleigh was sentenced back in December to 99 months to 20 years incarceration on three separate charges — sexual assault, indecent assault and corruption of minors.

He will also register as a sexual offender for the rest of his life.

A motion to reconsider that sentence was rejected by Judge Gregory Hammond on Friday morning.

First Assistant District Attorney Cody Brown summarized the conduct in the case before arguing that the sentence imposed was “clearly appropriate.”

According to the affidavit of probable cause, assaults dating to January and July 2022 against the victim were reported July 8, 2022.

The victim reported being touched inappropriately by Burleigh in January and, in July, being grabbed by the arm, led into Burleigh’s room, and pushed onto the bed. She told a forensic interviewer that Burleigh had sex with her and that she told him to stop.

Hammond said on Friday that each charge relates directly to a different incident.

He sentenced Burleigh to the maximum at one charge and in the aggravated range of the sentencing guidelines on two others. He noted that the maximum sentence offense also fell in the standard range.

Referencing a request in the motion for the sentences to be changed to run concurrently rather than consecutive to one another, Hammond said that he finds it “obscene, frankly, and ridiculous” that an offender could continue to offend without further consequences.
