Corry man sentenced on assault charge

A Corry man initially charged with attempted homicide last June was sentenced on lesser charges Friday after home security footage exonerated him from the most serious charge.

Tab D. Hunter, 37, was sentenced by Judge Gregory Hammond on Friday morning on charges of criminal mischief and simple assault.

He had been charged with attempted homicide after a dispute with a woman and Daniel Heidler, who faced a firearm violation and false reports from the incident, as well.

Hunter was initially alleged to have fired multiple rounds in the direction of Heidler, according to the affidavit of probable cause.

According to state police, Heidler provided false information in the case against Hunter.

Hunter’s attorney, Jeffrey Veitch, said during court Friday that his client has no prior record score and is holding a full time job.

Veitch said his client was a Marine with multiple tours in the Middle East. He said his client was attacked and only drew his pistol after he was struck with a rifle.

He called it a “horrible situation” and said Hunter is fortunate that the District Attorney — who withdrew the attempted homicide charge last July and the Pennsylvania State Police continued the investigation.

District Attorney Rob Greene said a home video system provided information that resulted in withdrawing that charge. He said Hunter put the woman on the ground after she spit on him and said Hunter was subsequently hit on the back of the head with a rifle.

“(I’m) glad justice is being served here.”

Hammond then asked Hunter about a summary court martial for domestic violence in his record as well as a harassment charge six months prior to this incident.

Hunter, during the incident, did discharge rounds into the female’s vehicle and slashed her tires.

Hunter said the shots were a warning and he was “irritable” over the tires.

Hammond indicated he disagreed with it being “some type of self-defense move”

“I’m a little hesitant about this sentence,” he said, noting he does not believe Hunter is as innocent as he has been portrayed.

He then sentenced Hunter to one year probation, a $300 fine and 20 hours of community service on a count of simple assault and 11 days to one year incarceration with credit for 11 days time served and immediate parole, $550 in fines and fees, $500 in restitution, 40 hours of community service, a no contact/trespass order and continued VA treatment compliance.
