Russell man sentenced to prison

A Russell man will spend at least the next nearly six years in prison after being sentenced on two dockets Tuesday by Judge Gregory Hammond.

On the first docket against him, Charles Kemery, 54, pleaded guilty in July to a charge of second-degree felony sexual assault and misdemeanor indecent assault without consent of other while first-degree felony charges of statutory sexual assault – 11 years older, IDSI person less than 16 years of age and two counts of unlawful contact with a minor – sexual offenses were not prosecuted.

Other charges not prosecuted include two counts of third-degree felony corruption of minors – defendant age 18 or above, one count of misdemeanor indecent without consent of other and two misdemeanor counts of indecent assault of a person less than 16 years of age. Sentencing had been postponed in October after Kemery’s guilty plea at the defense’s request.

Hammond sentenced Kemery to 54 to 108 months in prison to satisfy the sexual assault plea as well as three years of probation after Kemery is released. Kemery was sentenced to an additional 3 to 6 months in prison to satisfy his guilty plea to indecent assault.

On a second docket, Kemery pleaded guilty to third-degree felony corruption of minors – defendant age 18 or above and a charge of indecent assault of a person less than 16 years of age. Kemery was sentenced to 12 to 24 months in prison to satisfy the corruption of minors charge and an additional 3 to 6 months to satisfy the indecent assault charge.

In total, Kemery will serve between 5.75 to 11.5 years in prison. The prison sentences will be served consecutively.

Police say in the affidavit of probable cause that a victim provided a written statement to police on Jan. 25, 2024. The victim reported to police that she was visiting the Allegheny Book Mart when she was a teenager in 2016 when Kemery befriended her. The victim said that, as they got to know one another, that Kemery would allegedly “ask her to pose for a picture with random items such as a medical human skull or pornographic DVDs,” the affidavit states, and would “speak to her about sexual things.”

She was back at the store the following year when Kemery allegedly “had her sit on his lap while viewing a pornographic magazine.” He then asked her to “wiggle” while she was on his lap. After, the victim said they shouldn’t have done that but said it excited him.

The victim reported to police, per the affidavit, that Kemery began touching her inappropriately and then asked if she would touch him.

“She declined,” the affidavit states. “(Kemery) then gave her $20, telling her not to tell anyone in fear of getting in trouble.”
