Jail sentence issued in statutory case
A Pleasantville man will spend time in jail and on house arrest on charges that he had sex with a 14-year-old.
Colton V. Miller, 20, was sentenced on a count of statutory sexual assault by President Judge Maureen Skerda.
According to Pennsylvania State Police, Miller had sex with a 14-year-old girl at a residence in Tidioute on the night of April 19, 2021.
A witness stated that she had seen Miller give alcohol to the alleged victim, who had eventually “passed out” due to the alcohol, according to the affidavit of probable cause.
The witness said she found a used condom on the floor and questioned Miller about it. According to the affidavit, Miller told her he and the alleged victim “did have sex.”
The alleged victim was interviewed at the Children’s Advocacy Center, where she told the interviewer that she and Miller had consensual sex.
Both the witness and the alleged victim told police that they had told Miller how old the alleged victim was, according to the affidavit.
Miller’s attorney, Bruce Sandmeyer, told the court that his client has taken responsibility and cooperated with the police from the beginning.
Sandmeyer told the court that the incident occurred at a party with heavy drinking and that there was “confusion” regarding age that night.
“(Miller) has shown tremendous remorse,” he added.
“You provided fireball to the victim,” President Judge Maureen Skerda said, an assertion that Miller denied.
“You took advantage of a situation,” she added, noting that the charge does not carry registration as a sexual offender.
She then sentenced Miller to a five year sentence including 90 days incarceration and 90 days house arrest with credit for 35 days time served in addition to $529.70 in restitution, $1,500 in fines and fees, a no contact/no trespass order, 80 hours of community service, submission of a DNA sample and participation in the COG program.
