Child assault case among many sentenced Friday
A Warren woman received a probationary sentence for smacking a 7-year-old child.
Kingsley Reese, 50, Warren, was one of many sentenced by Judge Gregory Hammond on Friday.
First Assistant District Attorney Cody Brown said Reese smacked a 7-year-old hard enough to cause visible bruising. “The strike was an instinct,” Reese told the court, stating that the child had hit her nerve-damaged leg.
Reese said she reported the incident and has since felt like a failure as a human, noting she loves the child and is “so very, very sorry.”
Hammond criticized her attempt at blaming the child.
“I don’t buy that for a minute,” he said, stating that other adults who are hit by children don’t do what she did. He explained, though, that he had to weigh the benefit of incarceration with the cost to the county from a medical perspective.
He called the conduct “inexcusable” and “unforgivable.”
Resse was then sentenced to two years probation, $375 in fines and fees, 40 hours of community service, submission of a DNA sample, no contact/no trespass order as well as participation in anger management and a cognitive education program on a count of simple assault.
The following defendants were also sentenced on Friday:
¯ Kelly Bounds, 60, Corry, Pa., to six months to two years less one day incarceration in the county jail with credit for 37 days time served, work release and early reentry eligibility, $250 in fines and fees, community service and drug and alcohol and mental health evaluations and compliance with recommendation on a count of resisting arrest and 90 days probation on a count of public drunkenness.
¯ Brian E. Depto, 36, Kane, Pa., to two days to two years less one day incarceration with credit for two days time served making him eligible for immediate parole, $925 in fines and fees, submission of a DNA sample, 40 hours of community service and compliance with treatment recommendations on a count of recklessly endangering another person as well as one year probation, a $300 fine and 20 hours of community service on a count of disorderly conduct.
¯ Joshua A. Farnsworth, 30, Warren, to one year probation, $675 in fines and fees, compliance with treatment recommendations and 20 hours of community service on a count of harassment as well as a $300 fine on a count of public drunkenness.
¯ Brian D. Fox, 45, Warren, to five years restrictive probation including 90 days incarceration with credit or time served, $2,250 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, 50 hours of community service, compliance with drug and alcohol treatment recommendations, an 18 month license suspension and submission of a DNA sample on a count of DUI and $70 on a count of careless driving. At a second docket, Fox was sentenced to six months to five years incarceration with credit for time served, submission of a DNA sample, $2,350 in fines and fees, to undergo a mental health evaluation and comply with treatment recommendations, 50 hours of community service and an 18 month license suspension on a count of DUI as well as $70 each on charges of fail to notify change in address and careless driving.
¯ Steven L. Hinson, 29, Warren, to two days to two years less one day incarceration in the county jail with credit for two days time served making him eligible for immediate release, $550 in fines and fees and 30 hours of community service on a count of resisting arrest as well as a $300 fine on a count of harassment.
¯ Michael L. Lindstrom, 50, Irvine, to one year probation, $350 in fines and fees, compliance with treatment recommendations and 30 hours of community service on a count of possession of a controlled substance.
¯ Tracy L. Madigan, 49, Warren, to six months probation, $1,075 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, compliance with treatment recommendations and 15 hours of community service on a count of DUI as well as $70 on a count of no headlights.
¯ Amanda N. McClellan, 38, Jamestown, NY, to 169 days to one year incarceration in the county jail with credit for 169 days time served, $775 in fines and fees and 20 hours of community service on a count of possession of drug paraphernalia. At a second docket, McClellan was sentenced to six months probation including 72 hours incarceration with credit for 72 hours time served and immediate parole to inpatient treatment when available, $1,175 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a DUI count as well as $70 on a count of careless driving.
¯ Brian S. Ott, 41, Sugar Grove, to six months restrictive probation including 72 hours incarceration, $1,750 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, to undergo a drug and alcohol evaluation and comply with recommendations, 15 hours of community service and a 12 month license suspension as well as $245 on a count of driving without a license.
¯ Daniel C. Stull, 58, Bear Lake, to nine months to two years less one day incarceration in the county jail, work release and early reentry eligibility, $375 in fines and fees, to undergo a drug and alcohol evaluation and comply with recommendations, submission of a DNA sample and completion of a healthy relationships program on a count of simple assault.
¯ James R. Sullivan, 33, Meadville to three months to two years less one day incarceration in the county jail, work release and early reentry eligibility, $625 in fines and fees, 40 hours of community service, submission of a DNA sample and a no contact/no trespass order on a count of receiving stolen property.
¯ Elizabeth A. Wilcox, 55, Warren, to five years restrictive probation including 90 days house arrest, $2,125 in fines and fees, compliance with treatment recommendations, 50 hours of community service, participation in the victim impact panel and alcohol highway safety school programs, $50 in restitution, submission of a DNA sample and an 18 month license suspension on a count of DUI as well as $70 on a count of careless driving.
¯ Travis L. Williams, 42, Sugar Grove, to four months to two years less one day incarceration including 14 days credit for time served, $500 in fines and fees, work release and early reentry eligibility, submission of a DNA sample, anger management, compliance with treatment recommendations and 30 hours of community service on a count of simple assault as well as one year probation and 15 hours of community service on a count of resisting arrest.
¯ Darryl R. Wurst, 59, Clarendon, to one year probation, $375 in fines and fees, $6,162.50 in restitution and 20 hours of community service on a count of disorderly conduct and a $300 fine on a count of harassment. At a second docket, Wurst was sentenced to one year probation, $125 in fines and fees and 20 hours of community service on a count of false alarm to an agency of public safety and a $300 fine on a count of disorderly conduct.
Bench warrants were issued for the following defendants for failure to appear:
¯ Adam R.L. Rodgers, 30, Russell. Rodgers was to be sentenced on charges of DUI, possession of a controlled substance and period for requiring lighted lamps.
¯ Donald A. Walters, Tiona. Walters was to be sentenced on two dockets including charges of possession of a controlled substance, fraud — alter/forge/counterfeit title, registration or insurance and investigation by officer/duty of operator.
