2 men charged after alleged relationship with female, 16

Two Warren men were jailed on charges relating to an alleged relationship with a 16-year-old female.

Austin P. Kelly, 26, 213 Oneida Ave., and Zachary B. Miller, 29, 12 W. Third Ave., were arrested and charged on Monday. Each face the same three charges — photograph/film/depict on computer — sex act, child pornogaphy and corruption minors.

Both were being held in the Warren County Jail on $10,000 bail after being arraigned by District Judge Raymond Zydonik.

The investigation dates back to July when city police responded to a report of a domestic dispute at Soldiers & Sailors Park on July 20. Officers arrived on scene and found Kelly and the juvenile “on the steps of the park kissing,” per the affidavit of probable cause.

Police interviewed the two and were told that they “have been sharing pornographic pictures with each other over the phone.”

Search warrants were executed on the phones of Kelly and the juvenile. Police say they discovered “many text messages” between the two as well as photos of both the juvenile and Kelly “in various stages of undress” and “performing sexual acts.”

The search warrant of the juvenile’s phone also found pictures of Miller “exposing himself and asking the juvenile if she wanted him.”

Police detail in the affidavit that the juvenile was interviewed at the Child Advocacy Center. She revealed that she had engaged in virtual sexual acts with Kelly and had sexual relations twice with Miller.

She told the CAC that Miller had also promised to tattoo her. She paid Miller to do so, per the affidavit, but Miller never followed through . Miller “did attempt,” she further disclosed, “to get more money from the victim stating he needed money for his prescription drugs.”

Kelly allegedly told police that he knew the juvenile was 16 and “they were not going to have sex until she was 18-years-old.”

Miller, police say, said he “didn’t know the juvenile was only 16-years-old.”

Preliminary hearings against both defendants are scheduled for Feb. 24.
