Nine defendants plead guilty, two bench warrants issued

Nine defendants entered guilty pleas, 11 pled not guilty and two bench warrants were issued during arraignment and change of plea proceedings before President Judge Maureen Skerda on Thursday.The following pled guilty:

¯ Frances M. Brown, Bear Lake, to DUI: Combined alcohol and drug or combination of drugs, operation following suspension of registration, required financial responsibility and driving on roadways laned for traffic. Charges of DUI: General impairment/incapable of safe driving with accident – first offense, notice of change of name or address, driver required to be licensed, fail to notify change in address and careless driving were not prosecuted.

¯ Richard J. Edwards, Warren, to criminal trespass and theft from a motor vehicle. A count of possession of controlled substance was not prosecuted. At a second docket, he pled guilty to DUI: Combined alcohol and drug or combination – third offense, driving while operating privilege suspended or revoked, display plate card in improper vehicle, required financial responsibility, tire equipment and traction surfaces. Charges of DUI: General impairment/incapable of safe driving – third offense, DUI: General impairment (BAC .08-.1) – third offense, driving an unregistered vehicle, operating a vehicle without a valid inspection, rear lighting, obedience to traffic control devices and two counts each of restriction on alcoholic beverages and restraint systems were not prosecuted.

¯ Steven G. Klakamp, Union City, to DUI: Controlled substance – impaired ability – third offense and driving while operating privilege suspended or revoked. Charges of possession – small amount of marijuana, possession of drug paraphernalia and restraint systems were not prosecuted.

¯ Michael E. McIntyre, Warren, to charges on four separate dockets: Guilty to receiving stolen property while a count of theft by deception was not prosecuted; Guilty to conspiracy (theft by deception) while a count of retail theft was not prosecuted; Guilty to conspiracy (theft by deception) while a count of retail theft was not prosecuted and guilty to conspiracy (theft by deception) while a count of retail theft was not prosecuted.

¯ Stephan A. Pillars, Jr., Warren, to charges on three dockets: Guilty to theft by deception; Guilty to theft by unlawful taking while four counts of access device fraud and a count of criminal attempt (access device fraud) were not prosecuted and guilty to access device fraud while charges of access device fraud, theft by unlawful taking and theft from a motor vehicle were not prosecuted.

¯ Anthony T. Pollaro, Warren, to failure to prevent catastrophe, criminal mischief, driving while under suspension and damage to real property by operating a motor vehicle. A count of accidental damage to unattended vehicle or property was not prosecuted.

¯ Alice F. Simmons, Jamestown, NY, to conspiracy (retail theft). A count of retail theft was not prosecuted.

¯ Jonathon R. Smith, Warren, to DUI: Highest rate of alcohol – first offense, driving on roadways laned for traffic and restriction on alcoholic beverages. Charges of DUI: Controlled substance – impaired ability – first offense, DUI: Combined alcohol and drug or combination of drugs, driving an unregistered vehicle and careless driving were not prosecuted.

¯ Dakota J. Weilacher, Youngsville, to DUI: Controlled substance – Schedule I – first offense. Charges of possession – small amount of marijuana and possession of drug paraphernalia were not prosecuted. At a second docket, he pled guilty to theft by unlawful taking and conspiracy (receiving stolen property). A count of receiving stolen property was nor prosecuted.

The following defendants pled not guilty:

¯ Joseph Cody Almeda, Corry. Almeda has been charged with DUI: Controlled substance – Schedule I – first offense, improper tires studded, driving while operating privilege suspended or revoked, required financial responsibility, careless driving, fail to use safety belt, operating a vehicle without valid inspection.

¯ Richard Justin Hanson, Warren. Hanson has been charged with two counts each of possession with intent to deliver and criminal use of a communications facility, three counts of possession of a controlled substance and a single count of firearms not to be carried without a license.

¯ Terri G. Hulse, Tidioute. Hulse has been charged with person not to possess, use, etc. firearm.

¯ Matthew Alan Jamieson, Tidioute. Jamieson has been charged with DUI: General impairment/incapable of safe driving – first offense, DUI: Highest rate of alcohol – first offense, disregard traffic lane, careless driving and reckless driving.

¯ Brian Jeffery Knisley, Sheffield. Knisley has been charged with marijuana – small amount of personal use, DUI: General impairment/incapable of safe driving – second offense, driving without a license and driving while license suspended or revoked.

¯ Robert J. Kreitzbender, Youngsville. Kreitzbender has been charged with aggravated assault, terroristic threats, resisting arrest, disorderly conduct obscene language/gesture, DUI: General impairment/incapable of safe driving – first offense, turning movements and required signals, failure to stop at red signal, public drunkenness and harassment.

¯ Gerald Wayland Lundberg, Warren. Lundberg has been charged marijuana – small amount personal use, possession of drug paraphernalia, DUI: Controlled substance – Schedule I – first offense, DUI: Controlled substance – Metabolite – first offense, DUI: Controlled substance – impaired ability – first offense, driving without a license, driving while BAC .02 or greater while license suspended, exceed 55 mph in other location by 21 mph, careless driving and restrictions on alcoholic beverages.

¯ Jeremiah G. Lyon, Clarendon. Lyon has been charged with DUI: General impairment/incapable of safe driving – first offense, DUI: Highest rate of alcohol – first offense, exceed max speed limit by 11 mph and careless driving.

¯ Nathan Scott Nulph, Warren. Nulph has been charged with aggravated assault – victim less than six and defendant 18 or older, two counts of aggravated assault, unlawful restraint of minor/parent – risk of bodily injury, endangering the welfare of a child, unlawful restraint/serious bodily injury, simple assault, recklessly endangering another person, resisting arrest, disorderly conduct – engage in fighting, strangulation – applying pressure to throat or neck and strangulation – blocking the nose and mouth of the person.

¯ Michael William Ott, Sugar Grove. Ott has been charged with burglary – not adapted for overnight accommodation, no person present, theft by unlawful taking and criminal mischief – damage property.

¯ Jason Rafter, Youngsville. Rafter has been charged with two counts of possession of firearm prohibited and three counts of possession of drug paraphernalia.

Bench warrants were issued for the following individuals for failure to appear:

¯ Justin Daniel Kohnen, Sheffield. Kohnen has been charged with DUI: General impairment/incapable of safe driving – first offense, DUI: High rate of alcohol – first offense, disregard traffic lane, careless driving and operating vehicle without valid inspection.

¯ Sara M. Lang, Corry. Lang has been charged with possession with intent to deliver, deposits, stores, disposes chemical waste, risking catastrophe, possessing phenylpropanolamine, etc. or a precursor substance with intent to unlawfully manufacture, knowingly possess ephedrine, possession of a controlled substance, five counts of possession of drug paraphernalia and three counts of control of property regulations.
