21 defendants handed sentences

Twenty-one defendants were sentenced before Judge Gregory Hammond on Friday morning while a bench warrant was issued for one defendant who failed to appear.

All periods of incarceration are in the Warren County Jail unless otherwise specified.

Robert L. Barrett, Sheffield, to a six-month intermediate punishment sentence including 30 days incarceration on a count of DUI: General impairment incapable of safe driving with accident second offense. The remainder of the punishment will be served on probation. Barrett was ordered to pay $1,300 in fines and fees, to complete the alcohol highway safety school and victim impact panel programs, 30 hours of community service, one year driver’s license suspension and follow recommendations for drug and alcohol treatment. He is work release and early re-entry eligible. He was fined a total of $1,2965, sentenced to an additional year license suspension and given credit for time served on a count of driving license suspended/revoked. He was fined a total of $70 on charges of careless driving and move vehicle unsafely and $55 for a restraint systems violation.

Cody P. Bruner, Union City, to between 147 days and 18 months less one day incarceration with credit for time served, one year probation, $1,350 in fines and fees, one year driver’s license suspension, 50 hours of community service and DNA testing on a count of possessing red phosphorus etc. with intent to manufacture controlled substance. He was sentenced to six months probation, $400 in fines and fees, an additional year of license suspension and 15 hours of community service on a count of knowingly possess ephedrine. For a possession of drug paraphernalia charge, he was sentenced to an additional year probation, $400 in fines and fees and 20 hours of community service. For DUI: Controlled substance impaired ability first offense, he was sentenced to 72 hours to six months incarceration, $1,425 in fines and fees, completion of the AHSS and VIP programs, a 12 month license suspension, 15 hours of community service and to comply with all drug and alcohol treatment recommendations. He was fined a total of $70 for careless driving.

Carrie A. Campbell, Sugar Grove, to a six-month intermediate punishment with the first 72 hours incarceration and the rest served as probation on a count of DUI: Highest rate of alcohol first offense. Campbell was find a total of $1,975, to complete the AHSS and VIP programs, a 12-month license suspension, 15 hours of community service and compliance with drug and alcohol recommendations. She is work release and early re-entry eligible. On a count of driving on roadways laned for traffic, Campbell was fined a total of $70.

Amber M. Caudill, Warren, to a six-month intermediate punishment with the first 48 hours incarceration and the rest probation on a count of DUI: Highest rate of alcohol first offense. She was fined $1,050 in fines and fees, to complete the AHSS and VIP programs, a 12-months license suspension, 15 hours of community service and to comply with all drug and alcohol recommendations. Caudill is work release and early re-entry eligible. Charges of driver required to be licensed, required financial responsibility and careless driving resulted in fines of $245, $345 with an additional three month license suspension and three month registration suspension and $70 respectively.

Randy L. Halstead, Jr., West Sunbury, Pa., to 10 to 20 months incarceration on a count of burglary not adapted for overnight accommodation. He was fined a total of $1,500, to pay $8,144.43 in restitution, to have no contact with the victim and not trespass on the victim’s property, submit a DNA test and undergo a drug and alcohol evaluation and comply with recommended treatment. He is work release and early re-entry eligible. On a count of criminal conspiracy (theft by unlawful taking), he was sentenced to two months less two days to four months less one day incarceration, two years of consecutive probation and a $1,000 fine.

Cody L. Hennessey, Warren, to 95 days to two years less on day incarceration with credit for time served, one year probation, $600 in restitution, $1,500 in fines and fees, to undergo a drug and alcohol evaluation and follow all recommendations, submit a DNA test, have no contact with the victim or trespass on Northwest Savings Bank property and 80 hours of community service on a count of forgery. He is eligible for immediate parole with an approved parole plan. For a count of identity theft, he was sentenced to one year consecutive probation, a $500 fine and 20 hours of community service. He was sentenced to an additional consecutive year of probation, a $300 fine and 20 hours of community service on a count of criminal attempt (theft by deception).

Joseph G. Hensley, Youngsville, to 11 months to two years less one day incarceration, $2,122 in restitution, $1,500 in fines and fees, to complete a drug and alcohol and mental health evaluations and follow all recommendations, submit a DNA test and have no contact with the victim or the victim’s property on a count of criminal mischief. He was sentenced to an additional two years consecutive probation and $1,000 fine on a count of recklessly endangering another person.

Christopher J. Jenkins, Jamestown, N.Y., to one year and two days to two years less one day incarceration, two years of consecutive probation, $1,375 in fines and fees to have no contact with the victim and undergo a mental health evaluation and continue with/follow recommendations on a charge of simple assault.

Jack D. Larson, Warren, to one year probation, $675 in fines and fees, 20 hours of community service and no contact with the victim or the victim’s property on a count of retail theft.

Timothy A. Martin, Kennedy, N.Y., to six months probation, $650 in fines and fees, to complete the AHSS and VIP program, 15 hours of community service and to comply with drug and alcohol recommendations on a count of DUI: General impairment incapable of safe driving first offense. He was fined $70 on a count of driving vehicle at safe speed.

Joseph M. Passerell, to two to four years incarceration in a state correctional facility with credit for time served on charges of burglary overnight accommodation and theft by unlawful taking. He was fined a total of $2,125, ordered to submit a DNA sample, undergo a drug and alcohol evaluation and follow any recommendations, have no contact with the victim or the victim’s property and is boot camp and recidivism risk reduction incentive eligible.

Joseph G. Pitner, Sugar Grove, to a six-month intermediate punishment sentence including 30 days incarceration and the rest probation on a count of DUI: General Impairment incapable of safe driving with accident second offense. Pitner was fined $1,250, ordered to complete the AHSS and VIP programs, sentenced to a 12 month license suspension, to comply with mental health and drug and alcohol treatment recommendations and ordered to complete 30 hours of community service. He is work release and early re-entry eligible. On charges of driving on roadways laned for traffic and careless driving he was fined $70 in addition to a $55 fine on a restraint system violation.

Ricky L. Powell, Corry, to a six-month intermediate punishment including 30 days incarceration on a count of DUI: Highest rate of alcohol first offense. The rest will be served as probation. He was fined $2,125, ordered to complete the AHSS and VIP programs, to complete 15 hours of community service and a 12 month license suspension and comply with drug and alcohol recommendations. He was fined $70 on charges of meeting vehicle proceeding in opposite direction and careless driving and $55 for a restraint systems violation.

Andrew J. Sheldon, Panama, N.Y., to a five-year intermediate punishment consisting of 30 days incarceration, 60 days of house arrest with SCRAM monitoring with the rest served as probation on a count of DUI: Highest rate of alcohol second offense. He was fined a total of $2,350, ordered to complete the AHSS and VIP programs and undergo a drug and alcohol evaluation and follow any recommendations in addition to an 18 month license suspension. He is work release and early re-entry eligible. On counts of driver required to be licensed, careless driving and failure to notify police of accident/damage to vehicle, he was fined $245, $70 and $70, respectively.

Dillon Stinedurf, Corry, to between 16 and 48 months incarceration with credit for 185 days time served in a state correctional institution on charges of forgery and theft by unlawful taking. He was fined a total of $2,125, $770 in restitution, to have no contact with the victim or the victim’s property and to submit a DNA test. He is boot camp and recidivism risk reduction incentive eligible.

Lugene H. Sturdevant, Youngsville, to one year consecutive probation, $525 in fines and fees and 20 hours of community service on a count of possession of drug paraphernalia. On a count of possession of a controlled substance, he was sentenced to one year of consecutive probation, $525 in fines and fees and 20 hours of community service. At a separate docket, he was sentenced to one year consecutive probation, $675 in fines and fees and 20 hours of community service on a count of theft by unlawful taking.

Terry L. Wagner, Warren, to a six-month intermediate punishment, including 48 hours incarceration and the duration on probation on a count of DUI: High rate of alcohol first offense. Wagner was fined a total of $1,000, ordered to complete the AHSS and VIP programs, to complete 12 hours of community service and his license was suspended for 12 months. Wagner is work release and early re-entry eligible. Wagner was ordered to follow drug and alcohol treatment recommendations. On a count of driving while under suspension, Wagner was fined $245 and Wagner’s license was suspended for an additional 12 months.

Donald E. Wester, Warren, to a five-year intermediate punishment to include 30 days incarceration with credit for 28 days time served followed by 60 days of house arrest with SCRAM monitoring. The duration will be served on probation. He was fined a total of $2,325, ordered to pay restitution of $8,550 and complete the AHSS and VIP programs. His license was suspended for 18 months and he was ordered to complete 30 hours of community service. On charges of careless driving and accidental damage to unattended vehicle/property he was fined $70 and $300, respectively.

Kristal R. Whitmore, Corry, to 136 days to two years less one day incarceration with credit for time served making her eligible for immediate parole on a count of criminal trespass. She was fined $1,000, sentenced to one year probation, to pay $576.94 in restitution, undergo a drug and alcohol evaluation and follow recommendations, complete 50 hours of community service and submit a DNA sample.

James R. Wightman, Erie, to 181 days to two years less one day with credit for time served on a count of simple assault. Hammond said he would be eligible for immediate parole to the custody of the state parole board. He was fined a total of $750 and to have no contact with the victim or the victim’s property

Douglas A. Yuchnitz, Sugar Grove, to between 20 and 60 months with credit for time served in a state correctional institution on charges of possession with intent to deliver and possession of controlled substance. He was fined a total of $2,825, ordered to pay back $600 in buy money to the Warren County Drug Task Force, undergo a drug and alcohol evaluation and follow recommendations and submit a DNA test. His license was suspended for a total of 188 months. He is recidivism risk reduction incentive eligible but not boot camp eligible.

A bench warrant was issued for the arrest of Riley N. Brown, Warren, for failure to appear for sentence court. Brown was to be sentenced on charges of simple assault and criminal mischief.
