Clarendon man jailed after incident at Walmart

A Clarendon man was jailed after allegedly trespassing and resisting arrest Monday at Walmart.

James A. Frederick, 63, was charged with misdemeanor charges of resisting arrest, defiant trespass, disorderly conduct and criminal mischief on one docket and with misdemeanor harassment on a second docket, both involving incidents stemming from the Walmart store in Conewango Township. Frederick was arraigned Monday by Magisterial District Justice Raymond Zydonik on the resisting arrest, trespass, disorderly conduct and criminal mischief charges and taken to the Warren County Prison after being unable to post $35,000 bail. A preliminary hearing will be held Oct. 1 in Zydonik’s courtroom.

According to the Affidavit of Probable Cause, officers were contacted by Walmart loss prevention personnel regarding a disturbance who were attempting to stop two people on their way into the store after a previously reported incident and issues with the two people. Loss prevention called police after the two refused to leave the store and demanded to speak with Walmart officials.

Officers said Frederick refused to answer any questions and was told he was being placed on notice of trespass. The officer allegedly provided Frederick with the written notice of trespass from Walmart, with Frederick allegedly still refusing to leave the store.

“After asking and telling the defendant to leave, the defendant began walking back into the Walmart store from the vestibule,” the affidavit states. “I stepped in front of the defendant, stopping him. The defendant began being loud and causing a disturbance in Walmart, to the point several shoppers all stopped and were inconvenienced, annoyed and/or alarmed. I attempted to place the defendant in handcuffs behind his back to place him under arrest for trespass. The defendant pulled away and stated, ‘This is an unlawful arrest. I’m allowed to resist.'”

Police also allege Frederick was loud and disorderly, yelling that his rights were being violated and that he needed the State Police and the FBI. During the incident, an officer’s body camera was allegedly broken.

The harassment charge stems from earlier in the month. On Sept. 14, officers investigated a complaint lodged by a Walmart employee who alleged that Frederick confronted her outside the store on Sept. 13 while she was taking a break about the woman smoking a cigarette. Another employee interrupted the conversation, allowing the woman to go back inside Walmart. On Sept. 14, Frederick allegedly approached the woman while she was working at a cash register and allegedly continued to harass her. She said Frederick allegedly blocked her path from leaving the register. Eventually, she was able to get away and walk to the employees-only section of the store, according to the Affidavit of Probable Cause.

“The victim was significantly alarmed and concerned about the defendant’s actions,” the affidavit states. “The victim also reported that on Sept. 18, her husband received a phone call from a person claiming to be Walmart. When the victim answered the phone, the defendant is reported to have said, ‘Sharon this is not over.’ The victim in this case has not felt safe to return to work and has sought other assistance due to the emotional distress the actions of the defendant has caused her.”
