Decades-long sentence given for child porn

A Corry man will spend at least the next 20 years in prison for possessing multiple pieces of child pornography.

Mason T. Swanson, 33, was also deemed a sexually violent predator by Judge Gregory Hammond as a result of a Monday hearing.

That designation was based on testimony by Brenda Manno with the state Sexual Offender Assessment Board at the outset of the proceeding.

Manno testified that Swanson participated in the evaluation.

He reportedly told a SOAB investigator that he had viewed such pornography since he was a child, knew it was illegal but claimed it “wasn’t that big of a deal. Now I’m looking at 50 years.”

Manno then detailed Swanson’s prior record, which include both an exposure charge as a juvenile and a 2014 conviction for indecent assault and corruption of minors against a 13-year-old female victim. She explained the state statute requires the evaluator to determine whether there is a mental abnormality or personality disorder present and whether the conduct is predatory.

Specific diagnoses presented in the hearing include unspecified paraphilic disorder as well as an antisocial personality disorder. Manno said that it’s her view that the conduct is predatory as defined by state law. She also cited an “established pattern of behavior” both hands-off and hands-on and explained that the conduct does not need to be physically violent to be found to be violent under the law.

“He readily admits attraction to children,” Deputy Attorney General Angela Raver added.

The hearing then shifted into the sentencing phase.

Chief Public Defender Kord Kinney, representing Swanson, told the court that the sentence on the child pornography charges was agreed upon with the Commonwealth.

Raver said the charge brought a 25- to 50-year mandatory minimum but that the Commonwealth agreed to the sentence imposed, which was lengthy due to the “egregious nature” of the offenses.

Swanson was also sentenced on two dockets including aggravated harassment by prisoner and simple assault from incidents that occurred in the county jail against jail staff while he was held on the child pornography charges.

Swanson claimed the incidents occurred during a cell extraction and he “happened to spit in one of their faces” and kick another corrections officer.

Regarding the child pornography charges?

“I regret having done it,” Swanson said, claiming that he did not realize there was “a life-threatening … response to it” and is “likely to end (my) freedom forever.”

Hammond said Swanson’s statements regarding child pornography to the SOAB are “mind-boggling to me.”

“Clearly… you have an inability to express any remorse for victims,” he said, both for the corrections officers and children in the child pornography.

He specifically addressed the victims of possessing child pornography.

“You and others that view that create a marketplace for (it),” Hammond said. “It is not a victimless crime.”

He acknowledged the severity of the sentence — Swanson will be under supervision until he is 90 years old — but said that “has to be done in your case.”

The aggregate total of the sentence is 23 to 56 years in state prison.

He was given credit for 336 days time served and five years of probation in addition to lifetime registration as a sexual offender, sexual offender counseling requirements, submission of a DNA sample and $500 in fines and fees on charges including seven counts of possession of child pornography, aggravated harassment by prisoner and simple assault.
