Plea entered in meth, fentanyl case

A December traffic stop kicked off a sequence of events that resulted in a drug delivery plea on Monday.

Michael Baxter, 38, entered the plea before President Judge Maureen Skerda.

According to the affidavit of probable cause, detectives were on patrol back in December on Market Street in North Warren when they recognized a known individual operating a vehicle on a permit only.

Detectives say they then observed the vehicle strike the yellow center line three times, initiating a traffic stop at the 400 block of South Main Street. Baxter, police allege, admitted to driving on the permit.

“While speaking with Baxter he was visibly nervous,” police allege. “His hand was trembling… and he would not make eye contact with me.”

Police concluded he was under the influence of a stimulant. Police say Baxter consented to a search of both his person and the vehicle.

“A search of the vehicle,” detectives said, “had yielded approximately 56 grams of methamphetamine and five grams of fentanyl in the backseat of the pickup.”

Detectives quoted Baxter saying “Damn, another PWID,” which stands for possession with intent to deliver.”

The plea on Monday was to possession with intent to deliver, possession of a controlled substance and possession of drug paraphernalia. Charges of possession with intent to deliver, possession of a controlled substance and two traffic offenses were not prosecuted in exchange for the plea.

At a second docket, Baxter pleaded guilty to possession of a controlled substance while charges of contraband and possession of drug paraphernalia were not prosecuted.
