Suspect waives right to hearing

A Titusville, Pa. man charged with allegedly raping a minor has waived his right to a preliminary hearing.

Rodney J. Boyle, 25, 44 Enterprise Rd., was charged by Warren-based Pennsylvania State Police last month.

According to the affidavit of probable cause, an interview was conducted with the 16-year-old victim on Oct. 16 at the Warren County Child Advocacy Center.

The victim reported an incident that occurred in late August at the Enterprise Rd. address. Boyle allegedly offered the victim raspberry vodka and told the interviewer that she became highly intoxicated and vomited in the yard of the residence prior to “passing out.”

She told the interviewer she awoke inside the residence at about 4 a.m. when Boyle was having sex with her, so intoxicated that she “couldn’t do anything. I couldn’t move. I couldn’t speak.”

She further disclosed that Boyle said he would get her “Plan B” birth control the following day.

The next day she said Boyle sent her a message “telling her he had placed a ‘Plan B’ type birth control item inside a McDonald’s cup and put it in the ditch close to her residence,” the affidavit states. “The victim stated she located the birth control and took the item.”

Police detail their efforts to determine if Boyle purchased the birth control. Boyle was subsequently identified on video/still photos at the Walmart in Titusville purchasing the item. Police also learned that Boyle had disclosed the assault to his brother.

Boyle and his girlfriend were subsequently brought in for an interview.

The girlfriend confirmed the victim was at the residence and had been drinking.

Boyle, police allege, then admitted to providing the alcohol and having sex with the victim and siad he “knew there would be consequences for what he had done.” He subsequently confirmed that he purchased the birth control and left it as the victim described.

Police say in the affidavit that Boyle “did seem remorseful for his actions and did eventually provide true and accurate information obtained during the investigation.”

He faces a litany of charges including rape — unconscious victim and involuntary deviate sexual intercourse — person uconscious, both first-degree felonies.

In addition, he has been charged with sexual assault, aggravated indecent assault — compliant is unconscious or unaware that penetration is occurring, indecent assault — person unconscious, corruption of minors,

sell/furnish liquor, etc. to a minor and other charges.

He remains in the Warren County Jail on $75,000 bail.
