Sex abuse cases scheduled for trial

Several cases involving sex crimes will be heard by a jury.

Charges on two dockets filed against Charles F. Kemery, 53, of Russell proceed to a trial scheduled for July 27-28 in Judge Gregory Hammond’s courtroom.

The first docket scheduled for trial alleges two counts of third-degree felony unlawful contact or communication with a minor, two counts of third-degree felony corruption of minors, a misdemeanor count of corruption of minors and two counts of misdemeanor indecent assault.

Police say in the affidavit of probable cause that a victim provided a written statement to police on Jan. 25, 2024. The victim reported to police that she was visiting the Allegheny Book Mart when she was a teenager in 2016 when Kemery befriended her. The victim said that, as they got to know one another, that Kemery would allegedly “ask her to pose for a picture with random items such as a medical human skull or pornographic DVDs,” the affidavit states, and would “speak to her about sexual things.”

She was back at the store the following year when Kemery allegedly “had her sit on his lap while viewing a pornographic magazine.” He then asked her to “wiggle” while she was on his lap. After, the victim said they shouldn’t have done that but said it excited him.

The victim reported to police, per the affidavit, that Kemery began touching her inappropriately and then asked if she would touch him.

“She declined,” the affidavit states. “(Kemery) then gave her $20, telling her not to tell anyone in fear of getting in trouble.”

On a second docket, Kemery faces charges of first-degree felony statutory sexual assault, first-degree involuntary deviate sexual intercourse, two counts of first-degree felony unlawful contact with a minor, second-degree felony sexual assault, two counts of third-degree corruption of minors and three counts of indecent assault.

A charge of rape was dismissed against Kemery earlier this year by Hammond.

Six felony charges filed against Dillon Gray will be heard at trial on Aug. 12 by Judge Hammond. Gray was charged with first-degree felony rape of a child, first-degree felony statutory sexual assault, first-degree involuntary deviate sexual intercourse with a child, second-degree felony incest of a minor, third-degree felony corruption of minors and third-degree felony indecent assault.

According to the criminal court docket, the incident allegedly took place Dec. 30, 2022, in Glade Township. On Sept. 30, 2024, a forensic interview was conducted at the Warren County Children’s Advocacy Center after State Police at Warren received a report of suspected child abuse from Warren County Children and Youth Services. The girl, according to an affidavit of probable cause, reported that Gray had “hurt her.” The affidavit detailed behavior that allegedly took place between Gray and the 2-year-old in “his tree house” where there were toys for her to play with. The girl said the activity took place more than once.

Other cases proceeding to trial include:

Douglas P. Hebner, who is scheduled for a standby trial on a charge of receiving stolen property. A standby trial was also scheduled for Charles W. Riddell on a third-degree felony charge of materially false written statement and unsworn falsification to authorities.

A trial was scheduled for Sept. 9 for Todd A. Witt, who faces charges of retail theft, criminal conspiracy and theft by deception..

Bench warrants were issued for Christopher Nelson on two dockets, one that includes charges of theft of services and criminal mischief and a second for a charge of theft by unlawful taking. A bench warrant was also issued for Bryan J. Postolowski for two counts of retail theft and two traffic citations.
