Warren man behind bars on rape charges
A Warren man faces rape charges and is behind bars stemming from an incident that occurred at a Dartmouth Street residence last week.
Joseph W. Madigan, 29, 713 Fourth Ave., Apt. 3C, faces charges of rape — forcible compulsion, aggravated indecent assault without consent and indecent assault — without consent of other filed by City of Warren police on June 11.
According to the affidavit of probable cause, police received a complaint from the victim “that she was just sexually assaulted.”
The victim was transported to Warren General Hospital for treatment and examination.
“The victim in this case stated that the defendant, Joseph W. Madigan, was an old friend and they had connected earlier in the evening online,” the affidavit alleges. Madigan, police say, met the victim and her friends at her residence.
The victim told police that they “were all hanging out talking and playing games” before Madigan left, returning later in the evening.
“The victim stated that they were outside in the backyard (as) it was raining so they went into a tent that was set up in the yard,” police detail. “The victim stated that she was in the tent with (Madigan) and her friends when he began to touch her and she told him to stop.
Police say the victim reported that Madigan “did not stop” and digitally assaulted her before raping her.
“The victim then stated that she continued to tell (Madigan) to stop and he held the victim’s arms to her chest so she couldn’t move,” the affidavit states. “The victim explained that when the suspect was finished, she got up and left the tent.”
Online court records indicate that Madigan was arraigned by District Justice Raymond Zydonik and remanded to the Warren County Jail after he was unable to post $50,000 bail.
A preliminary hearing in the matter has been scheduled for June 23 at 1 p.m.
