Bail halved for man charged in fatal accident
Bail was cut in half Wednesday for a Warren man accused of killing a man in a traffic accident on Monday.
Bail had originally been set at $150,000 for Cyrus L. Sears, 22. Sears was charged Tuesday with second-degree felony accidents involving death or personal injury, misdemeanor tampering with/fabricating physical evidence and accident involving damage attended vehicle/property as well as three traffic citations, including reckless driving, failure to stop and give information or render aid and failure to notify police department of an accident.
The bail reduction from $150,000 cash to $75,000 cash came during a scheduled preliminary hearing in front of Magisterial District Judge Raymond Zydonik during which charges were bound over to the Court of Common Pleas. Formal arraignment is scheduled for Feb. 12 in front of President Judge Gregory Hammond in the Court of Common Pleas.
According to a news release from the Warren Police Department, officers responded to a reported motor vehicle accident at 5:25 p.m. Monday. Witnesses said a black truck hit a 57-year-old man who was on an electric mobility scooter. The truck fled the area. The man on the scooter was pronounced dead by the Warren County Coroner.
“On arrival officers located the victim laying in the westbound lane of Pennsylvania Avenue with bystanders performing CPR,” the Affidavit of Probable Cause filed by Warren police states. ”
The affidavit states the accident took place as Sears was allegedly leaving the Country Fair at 4313 E. Pennsylvania Ave., Warren, proceeding north on Buchanan Street and then east on Madison Avenue. City police were able to find Sears at his residence roughly eight or nine blocks away, according to the affidavit.
“Officers secured the scene, while assisting officers searched the surrounding area for the suspect vehicle,” the affidavit states. “Officers reviewed security footage at Country Fair and identified the suspect as Cyrus Lee Sears, now known as the defendant.”
Officers spoke with Sears. According to the affidavit, he allegedly admitted to officers that he had hit something leaving Country Fair, drove home and then found a scooter under the front of his truck. Police said in a news release that the scooter was then removed from underneath the truck and concealed in the bed of the truck under a closed tonneau cover, something the affidavit states Sears allegedly admitted to when speaking with police.
Additional charges are possible as the investigation continues.
Several other cases were also bound over to the Court of Common Pleas on Wednesday, including:
– Richard L. Sweet, 52, who faces charges of first-degree felony rape of a child, first-degree felony statutory sexual assault – 11 years older, first-degree felony involuntary deviate sexual intercourse with a child, two counts of first-degree felony unlawful contact with a minor – sexual offenses, third-degree felony indecent assault of a person less than 13 years of age and third-degree felony corruption of minors – defendant age 18 or above. Magisterial District Judge Raymond Zydonik had previously set bail at $150,000, with that unchanged after Wednesday’s hearing. Sweet will be back in court Feb. 12 in front of Judge Hammond.
– Nathen W. Stahlman, 19, of Warren, who was charged Jan. 8 with first-degree felony unlawful contact with a minor – sexual offenses, third-degree felony unlawful contact with a minor – open lewdness and third-degree felony criminal use of a communication facility.
– William F. Birchard, 47, was charged Jan. 8 with second-degree felony strangulation by the State Police at Warren after a woman arrived at the State Police barracks in Warren claiming she had been harassed and then assaulted. Magisterial District Judge Daniel Miller, who set bail at $75,000 before Birchard was taken to the county jail.
