Sentences are handed down in county court

Sentences in several cases were handed down recently by Judge Maureen Skerda in the Court of Common Pleas. They include:

– Timothy A. Morvay, Jr., 45, of Corry, Pa., was sentenced to a minimum of 12 days and a maximum of 1 year of confinement as well as a $550 fine after pleading guilty to theft by unlawful taking – movable property Charges of burglary and conspiracy (burglary) were not prosecuted.

– DUI. Mark A. Blair, 63, Jamestown, N.Y., sentenced to participation in the ARD program for one year after pleading guilty to one charge of DUI: controlled substance – combinatin alcohol/drugs – first offense and a traffic citation in November following a 2023 traffic stop. Blair will also take part in an Alcohol Highway Safety School, Victim’s Impact Panel and community service.

– Jacob A. Zaner, 33, of Warren, was sentenced to a maximum of 16 months of probation and a $1,300 fine after pleading guilty to misdemeanor charges of intentional possession of a controlled substance by a person not registered and use/possession of drug paraphernalia. A felony charge of possession with intent to deliver, a third-degree felony charge of criminal use of a communications facility, charge of intentional possession of a controlled substance by a person not registered, and a misdemeanor charge of use/possession of drug paraphernalia were not prosecuted.

– Christopher C. Nelson, 47, of Sheffield was sentenced to between 62 days and 1 year of confinement and a $725 fine after pleading guilty to a charge of theft by unlawful taking – movable property. On a second docket, Nelson was sentenced to two years of probation to satisfy a charge of theft of services – acquisition of service. A charge of criminal mischief – damaging property was not prosecuted.

– Scott R. Johnson, 61, of Warren was sentenced to six months probation, attendance in an Alcohol Highway Safety School and Victim’s Impact Panel and $300 in fines after pleading guilty to DUI: general impairment/incapable of driving safely – first offense. a charge of DUI: highest rate of alcohol (BAC .16% or more) – first offense and a traffic citation were not prosecuted.

– Amanda L. Smith of Warren was sentenced to 16 months of probation after pleading guilty to a charge of DUI: controlled substance – impaired ability – first offense, use/possession of drug paraphernalia with no further penalty for a traffic citation. She was also sentenced to $1,025 in fines, attendance in an Alcohol Highway Safety School and a Victim’s Impact Panel. Charges of evading arrest or detention on foot, false identification to a law enforcement officer were not prosecuted.

– William Beitsinger, 52, was sentenced to 6 months probation to satisfy a guilty plea to DUI: high rate of alcohol (BAC .10-.16%) – first offense, a $525 fine, attendance in an Alcohol Highway Safety School and a Victim’s Impact Panel. There was no further penalty for a guilty plea to a traffic citation and a charge of DUI: general impairment/incapable of driving safely – first offense was not prosecuted. On a second docket, Beitsinger was sentenced to 24 months of probation after pleading guilty to simple assault. A first-degree felony charge of aggravated assault and a misdemeanor charge of harassment were not prosecuted. Beitsinger was also fined $1,300. On a third docket, Beitsinger was sentenced to 5 years probation after pleading guilty to DUI: highest rate of alcohol (BAC .16% or higher) – second offense to run concurrently with a prior probation sentence. He was also fined $750.

– Thomas E. Braley, 55, of North East, Pa., was sentenced to 12 months probation after pleading guilty to a charge of intentional possession of a controlled substance by a person not registered and a $1,000 fine. A felony charge of manufacture, delivery or possession with intent to manufacture or deliver and a misdemeanor charge of use/possession of drug paraphernalia were not prosecuted.

– Shawn M. Zurcher, 51, of Clarendon was sentenced to 6 months probation after pleading guilty to a charge of DUI: general impairment/incapable of driving safely – first offense, attendance in an Alcohol Highway Safety School and a Victim’s Impact Panel and $350 in fines. There was no further penalty after pleading guilty to two traffic citations while four traffic tickets were not prosecuted, along with a charge of DUI: highest rate of alcohol (BAC .16% or higher) – first offense.

– Laura A. Wilson, 34, of West Newton, Pa., was sentenced to 6 months probation after pleading guilty to DUI: general impairment/incapable of driving safely – first offense, attendance in an Alcohol Highway Safety School and a Victim’s Impact Panel and a $325 fine. Three traffic citations were not processed while there was no further penalty after Wilson pleaded guilty to a charge of careless driving.

– Amy J. Kubecki, 47, of Warren was sentenced to 7 years probation after pleading guilty to criminal trespass – entering a structure to run concurrently with to a prior sentence of jail time. She was also fined $750.

– Brett B. Payne, 37, of Randolph, N.Y., was sentenced to 6 months probation after pleading guilty to incapable of safely operating watercraft after imbibing alcohol or refusal of test – first offense, $325 in Fish and Boat Commission fines, attendance in a Victims Impact Panel and no further penalty after pleading guilty to a watercraft rules violation. Several watercraft violations were not prosecuted.
