Jamestown man sentenced five years after theft incident
A Jamestown, N.Y., man has been sentenced to jail time after pleading guilty to a pair of theft-related charges more than five years after the original incident.
Steven W. Mothershed, 49, was charged in January 2022 with first-degree felony burglary – overnight accommodation, no person present, misdemeanor theft by unlawful taking – movable property, criminal mischief – damaging property and third-degree felony criminal trespass – entering a structure.
The incident date is listed in online court documents is Oct. 16, 2020. Mothershed was arraigned in January 2022 by Magisterial District Judge Laura Bauer, who set bail that was then posted, allowing Mothershed to go free. After a defense-requested continuance was granted in June 2022, Mothershed failed to appear in court in August 2022 for a calendar call and a bench warrant was issued for his arrest.
Nothing happened in the case until August 2025, when Mothershed was found and jailed without bail. He pleaded guilty in the Court of Common Pleas before Judge Gregory Hammond on Aug. 19 to misdemeanor theft by unlawful taking – movable property and third-degree felony criminal trespass – entering a structure and criminal mischief, entering a structure. The first-degree felony charge of burglary – overnight accommodation, no person present was not prosecuted.
Mothershed was recently sentenced to 9 to 18 months of confinement to satisfy the criminal trespass charge and 9 to 18 months of confinement to satisfy the theft by unlawful taking charge, with no further punishment for the criminal mischief charge. Mothershed will also pay $1,611.21 in restitution.
Other sentences handed down by Hammond recently include:
– Kara Wagner, 40, of Warren was sentenced to between 2 months and 1 year, 11 months of confinement after pleading guilty to a charge of corruption of minors.
– Brent A. Robbins, 32, Kennedy, N.Y., was sentenced to between 2 months and 1 year, 11 months of confinement and to pay $850.77 in restitution after pleading guilty to a charge of retail theft – taking merchandise.
– Keith A. Chaplain, 49, of Warren was sentenced to between 9 months and 1 year, 11 months of confinement and to pay $198.74 in restitution after pleading guilty to a misdemeanor charge of simple assault. A second-degree felony charge of strangulation – applying pressure to throat or neck and a misdemeanor charge of harassment were not prosecuted.
– Morgan A.I. Rounds, 27, of Warren was sentenced to one year probation after pleading guilty to accident involving damage – attended vehicle/property with no further penalty for a guilty plea of driving while operating privileges suspended or revoked. Rounds will also pay $200 in fines. Three traffic citations on the docket were not prosecuted. The probation runs consecutively to a jail term of between 7 months and 1 year, 11 months to which Rounds was sentenced in July after pleading guilty to a charge of third-degree felony theft by unlawful taking – movable property.
– Gabriel J. Rowles, 40, of Warren was sentenced to one year of probation after pleading guilty to a misdemeanor charge of defiant trespass.
– Casey S. Hanlin, 54, of Corry was sentenced to seven years of probation after pleading guilty to DUI: high rate of alcohol (BAC .10-.16%) – third offense. A third-degree felony charge of endangering the welfare of children – parent/guardian/other commits offense and a charge of DUI: high rate of alcohol (BAC .10-.16%) – second offense were not prosecuted. Hanlin will also pay $1,525 in fines and was sentenced to attend an Alcohol Highway Safety School, Victims Impact Panel and community service.
– Daniel A. Harkins, 34, of Sugar Grove was sentenced to 6 months of probation, attendance of an an Alcohol Highway Safety School and Victims Impact Panel, community service and $575 in fines after pleading guilty to DUI: high rate of alcohol (BAC .10% to .16%) – first offense and three traffic citations.
– Maximilian Miranda, 23, of Warren was sentenced to 2 years of probation after pleading guilty to a charge of simple assault.
– Corey J. Hill, 39, of Warren was sentenced to 6 months of probation, $350 in fines, attendance in an Alcohol Highway Safety School and a Victims Impact Panel after pleading guilty to a charge of DUI: general impairment/incapable of driving safely – first offense and two traffic citations.
– Wendi Warren, 40, of Warren was sentenced on two dockets. On the first, she was sentenced to 6 months probation, $775 in fines, attendance at an Alcohol Highway Safety School and a Victims Impact Panel after pleading guilty to a charge of DUI: high rate of alcohol (BAC .10%-.16%) – second offense. A charge of DUI: high rate of alcohol (BAC .10%-.16%) – first offense was not prosecuted, there was no further penalty after pleading guilty to a traffic citation and four traffic citations were not prosecuted. On a second docket, Warren was sentenced to 6 months probation and $775 in fines after pleading guilty to DUI: high rate of alcohol (BAC .10%-.16%) – second offense. A charge of DUI: general impairment/incapable of driving safely – first offense and three traffic citations were not prosecuted while there was no further penalty after pleading guilty to a fourth traffic offense.
– William D. Smith, 54, of Sugar Grove was sentenced to 6 months probation, $300 in fines, attendance at an Alcohol Highway Safety School and a Victims Impact Panel after pleading guilty to a charge of DUI: general impairment/incapable of driving safely – first offense.
– Justin Townes, 37, pleaded guilty in Magisterial District Court in front of Judge Todd Woodin to charges of disorderly conduct and public drunkenness. He was sentenced to pay $250 in fines.
