Illegal tobacco sales result in charges
A Jamestown, N.Y., man faces charges after allegedly selling tobacco products without a license in Conewango Township.
The state Bureau of Enforcement and Taxpayer Assistance cited Michael R. Martinelli of Jamestown with two counts of sales without a license on Oct. 29. According to the citation by the state Department of Revenue, a check at Big Puff’s, 2761 Market St. Ext., Conewango Township, allegedly showed the store was allegedly selling tobacco products without the proper licensing. But a check of the state’s Open Data website showed the business allegedly has a Cigarette/OTP Retail license that expires in February 2025.
“On or about said date, the defendant did engage in the sale of other tobacco products, retail over-the-counter, without possessing a current validated Retail Other Tobacco Products license,” the citation states.
Cigarettes may be legally distributed in Pennsylvania only by dealers licensed by the Department of Revenue. Tobacco Products Licenses are applied for through the Pennsylvania Online Business Tax Registration service. Wholesaler & Manufacturer licenses are $1,500 per location. Retailer licenses are $25 per location.
