Russell man to prison for decades for assaulting girl
A Russell man will spend decades in state prison for the sexual assault of 7-year-old girl.
Michael D. Wolfe, 21, was sentenced Monday afternoon to 21 to 42 years incarceration by President Judge Maureen Skerda.
According to the affidavit of probable cause, Wolfe touched the alleged victim inappropriately and “made her view pornography.”
During a forensic interview, the alleged victim “advised that the defendant would offer her candy and his cellular device during the commission (of) this crime,” according to the affidavit.
Wolfe’s attorney, Chief Public Defender Kord Kinney, noted that Wolfe has no prior record and is a low risk to reoffend.
Assistant District Attorney Casey Strickland said the conduct occurred during the summer of 2022.
Wolfe “knew what he was doing was wrong,” she said, noting that the victim has “more courage than the defendant has had or will have in his life.”
Strickland said this is “not a momentary lapse of judgment. He was in a caretaking role” and “over and over and over again” bribed the victim.
“I have nothing to say,” Wolfe said when given the opportunity to speak.
Skerda stressed that this was his opportunity to make a statement.
“Only I didn’t do them,” he said of the crimes.
“A jury of your peers found that you did,” Skerda said.
She cited a “continuing course of conduct” in this incident, mentioning the age of the victim and frequency of assaults as well as his lack of prior record and revoked bail supervision which, she said, was revoked due to marijuana, internet and social media use and viewing pornography.
“You failed to adjust when given an opportunity to be in the community,” Skerda said.
Wolfe was then sentenced on three counts of aggravated indecent assault and three counts of corruption of minors.
The aggravated indecent assault charge, Skerda said, includes a 10 year mandatory penalty.
Two were ordered to be served consecutively while the third was made concurrent.
Other elements of the penalty on those counts include a no contact/trespass order, $2,525 in fines and fees, submission of a DNA sample, sexual offenders counseling, 125 days credit for time served and a total of six year probation.
Each count of corruption of minors included six to 12 months incarceration. Two of the counts were ordered to be consecutive with one concurrent.
The sentence also includes designation as a sexual offender for the rest of Wolfe’s life.
