Kane man sentenced for assaulting officers

A Kane man who assaulted officers has been sentenced to state prison.

Todd R. Long, 34, Kane, was sentenced by Judge Gregory Hammond on charges including assault by prisoner from an incident that occurred in May 2023.

His counsel, Douglas Sullivan, pointed out Long's "severe rehabilitative needs" and said it's his view that the "episode presents consistent" with someone with unaddressed mental health issues.

Sullivan said incidents like this can go "both ways" regarding whether there are additional charges, calling it an "unfortunate set of circumstances."

"Treating mental health isn't linear," he said. "It's constantly changing. He believed it was linear."

Both a detainer in McKean County and an aggravated assault conviction from 2015 were raised during the hearing.

Sullivan also addressed two misconducts -- one dealing with torn up shirts that Long said had to do with cleaning supplies and a second regarding a jail tablet.

"He's well aware" that a state sentence was coming, Sullivan added.

"It sounds like a long list of excuses to me," District Attorney Rob Greene said.

Greene said he attacked officers and kicked a door and that it required a "smorgasbord of officers" to control him.

"He's a violent individual, judge," Greene added, noting that mental health issues are not an excuse for violence.

Long said the incident began with a mental health crisis" and had an "unfortunate ending."

Hammond addressed the misconducts, noting that two socks were discovered that were tied with sandy material inside.

"Odd cleaning supplies there," he said.

Hammond also told Long that he was receiving a "significant break" with the plea agreement.

Long was then sentenced to 18-36 months incarceration with credit for 417 days time served, $375 in fines and fees, submission of a DNA sample and drug ad alcohol and mental health evaluations and compliance with treatment recommendations on a count of assault by prisoner as well as three to six months incarceration and $634.94 in restitution on a count of institutional vandalism, three to six months incarceration on a count of resisting arrest and one to two months incarceration on a count of cruelty to animals.
