Sentences handed down in county court
A Jamestown, N.Y., man will spend at least a year in state prison for dealing methamphetamine in Warren County.
John P. Houser, 35, was one of 17 individuals sentenced last Friday in county court by Judge Gregory Hammond.
According to the affidavit of probable cause, Houser accepted an electronic payment of $490 from a confidential informant working with the Warren County Drug Task Force in exchange for one-half ounce of methamphetamine on Aug 19, 2019, and $500 for another half-ounce of methamphetamine on Aug. 28.
Both controlled buys were conducted in Sugar Grove, according to the affidavit.
Police said Houser delivered 14 grams of methamphetamine during the first controlled buy and 12 grams during the second.
Houser was sentenced to 12 to 36 months incarceration with credit for 79 days time served, $475 in fines and fees, submission of a DNA sample, to undergo drug and alcohol and mental health evaluations and comply with recommendations and pay $980 in restitution to the Warren County Drug Task Force on a count of possession with intent to deliver.
Samantha D. Acevedo, 39, Warren, to 10 months to two years incarceration, $375 in fees and submission of a DNA sample on a count of simple assault.
Charles R. Earls, 51, Spartansburg, Pa., to a six month sentence including 72 hours incarceration, $1,900 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a count of DUI as well as 90 days to one year incarceration, $1,045 in fines and fees and 30 hours of community service on a count of operating a vehicle without ignition interlock.
Jared D. Eisenbrown, 34, Sheffield, to six months probation, $850 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, outpatient treatment and 15 hours of community service on a count of DUI as well as $120 for a speeding violation.
Richard L. Fitzgerald, 35, to a six month sentence including 33 days incarceration with credit for 33 days time served, $1,425 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a count of DUI as well as $245 for driving while under suspension and $345 for operating a vehicle without required financial responsibility.
Jordin S. Grove, 22, West Hickory, Pa., to 30 days to one year incarceration, $350 in fines and fees, drug and alcohol treatment and 20 hours of community service on a count of possession of a controlled substance.
Austin L. Jewell, 30, Pittsfield, to one year less two days to two years less on day of incarceration with credit for 32 days time served, five years probation, $800 in fines and fees, submission of a DNA sample, drug and alcohol treatment, 70 hours of community service and $5,500 in restitution. He was also sentenced to $70 each on charges of careless driving and passing where prohibited.
Andrew L. Lopez, 19, Erie, Pa., to 18 days to two years less one day incarceration with credit for 18 days time served, $375 in fines and fees, 40 hours of community service and submission of a DNA sample on a count of firearm not to be carried without a license.
Samuel J. Nicholson, 39, Tidioute, to four months to two years less one day incarceration, $500 in fees, anger management, 50 hours of community service, a no contact/no trespass order, $59,681.45 in restitution and submission of a DNA sample on a count of terroristic threats as well as a year of probation and 25 hours of community service on a count of simple assault.
Eric D. Olson, 54, Warren, to 15 months to five years incarceration with credit for one day time served, $2,300 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and to undergo a drug and alcohol evaluation on a count of DUI as well as 45-90 days incarceration and a $500 fine for driving on a suspended license, $345 for operating a vehicle without required financial responsibility and $70 for careless driving.
Kristin R. Ross, 32, Pittsfield, to 90 days to five years incarceration, $2,325 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and to undergo a drug and alcohol evaluation on a count of DUI as well as $70 for careless driving in addition to 12 months to seven years incarceration, $3,225 in fines and fees, submission of a DNA sample and $4,432.07 in restitution on an additional count of DUI.
Daniel R. Smith, 46, Bear Lake, to eight months to two years less one day incarceration with credit for one day time served, one year probation, $625 in fines and fees, 50 hours of community service and a no contact/no trespass order on a count of criminal attempt (criminal trespass) as well as one year probation, 20 hours of community service, $171.29 and a no contact/no trespass order on a count of harassment and 90 days probation and a no contact/no trespass order on a count of criminal mischief.
Kathryn I. Steinkamp, 31, Warren, to a six month sentence including 30 days of incarceration, $1,600 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, to undergo drug and alcohol and mental health evaluations, 15 hours of community service and $1,600 in restitution in a count of DUI as well as $70 on charges of careless driving, driving on roadways laned for traffic and driving on right side of roadway in addition to $345 for operating a vehicle without required financial responsibility.
Steven T. Stewart, 36, Warren, to one year probation, $625 in fines and fees, 30 hours of community service, a no contact/no trespass order, submission of a DNA sample and compliance with treatment on a count of simple assault.
Kyle S. Swick, 20, Warren, to 90 days probation, $550 in fines and fees, a no contact/no trespass order, 10 hours of community service and just over $4,500 in restitution on a count of criminal mischief.
A bench warrant was issued for Michael I. Barry, 39, Russell, for failure to appear. Barry was to be sentenced on charges of DUI and two traffic violations.
