Warren woman enters plea to bat attack, drug charges

A Warren woman pleaded guilty in county court Monday on charges including assault with a metal bat and possession of methamphetamine with the intent to distribute.

Marcella K. Gigliotti, 56, entered pleas to charges at four separate dockets during court proceedings Monday before President Judge Maureen Skerda.

Up first was a plea to simple assault, which Skerda stemmed from striking a victim multiple times with a metal bat. Gigliotti called it a “reaction” and said she was “not intending” to hurt the victim.

“It’s your conduct we’re talking about,” Skerda stressed.

A plea at a second docket was to a count of possession with intent to deliver. Skerda said Gigliotti was in possession of 5.5 grams of methamphetamine “with intent to distribute.”

“It was personal use,” Gigliotti responded.

A third docket included a plea to a count of driving on a DUI-suspended license which Skerda said comes with a two-year mandatory minimum sentence.

The final docket included pleas to DUI, possession of a controlled substance and driving on a suspended license.

Charges not prosecuted in exchange for the pleas include aggravated assault, harassment, criminal use of a communications facility, possession of a controlled substance, restrictions on alcoholic beverages, no rear lights, two counts of DUI, possession of drug paraphernalia and possession of marijuana.

Other pleas entered Monday include:

¯ Kevin S. Davis, 58, Sugar Grove, to fleeing and eluding, firearm not carried without a license and driving on a suspended license. Charges of aggravated assault, offensive weapons and three traffic violations were not prosecuted.

¯ Daniel C. Dumoulin, 46, West Chester, Pa., to fraud regarding title, registration or insurance, false identification to law enforcement, driving on a suspended license and failing to carry a license. Charges of fraud regarding title, registration or insurance, obstruct the administration of law and four traffic violations were not prosecuted.

¯ William H. Farley, 39, Brookville, Pa., to DUI and no rear lights. A count of DUI was not prosecuted.

¯ Dakotah J. Kaltenbach, 36, Warren, to criminal attempt — contraband.

¯ Kaela P. Reynolds, Warren, to simple assault, institutional vandalism and disorderly conduct. Charges including four counts of aggravated assault, escape, resisting arrest and harassment were not prosecuted.

¯ Benjamin L. Sears, II, 25, Clarendon, to two counts of disorderly conduct. Charges of aggravated assault, resisting arrest and disorderly conduct were not prosecuted.

¯ Jeffery A. Senear, 42, Jamestown, NY, to retail theft. A count of criminal attempt — retail theft was not prosecuted.

¯ Edward L. Shaffer, 59, Warren, to harassment. A count of simple assault was not prosecuted. Shaffer was then sentenced to a fine of $150.

¯ Kristopher A. Wright, 31, Youngsville, to DUI and driving while BAC .02 or greater. Charges of DUI and three traffic violations were not prosecuted.
