Man arrested for allegedly choking police officer

A Clarendon man was taken to Warren County jail on Friday after he allegedly was unruly at Warren General Hospital and ended up trying to choke a police officer.

Benjamin L. Sears II, 24, of Clarendon, is charged with aggravated assault, resisting arrest, and two counts of disorderly conduct.

According to the affidavit of probable cause, police were at the Warren General Hospital Emergency Room after 11 p.m. Thursday when they were told a man in the parking lot was causing a disturbance.

Police said they found Sears, who had been brought to the hospital for help by a friend.

“It was apparent that the defendant was highly intoxicated,” according to the affidavit. “Defendant was brought into the ER for… evaluation.”

Police said Sears left the room and yelled at other patients. After multiple such incidents, he was told he would be arrested if there was another, according to the affidavit.

“The defendant had another outburst,” police said. When he was told to place his hands behind his back and that he was being arrested for disorderly conduct, “the defendant began to struggle.”

Sears and an officer ended up struggling on the floor.

“The defendant attempted to wrap his hands around the (officer’s) throat,” police said in the affidavit. “I was able to draw my taser, deploy it, and gain control over the defendant.”

Sears was arraigned Friday before District Judge Laura Bauer and taken to Warren County jail after failing to post $10,000 bail.

A preliminary hearing is set for 9 a.m. Wednesday, Aug. 24.
