A Warren man was sentenced Friday to five to 10 years in state prison for child pornography and possession with intent to deliver.

Zachary B. Miller, 31, was determined to be a Tier I sex offender and will have to register with Pennsylvania State Police for 15 years after his release from prison. The Sexual Offenders Assessment Board did not find Miller to be a sexually violent predator.

In January, Miller entered guilty pleas in separate cases from 2021.

His attorney, Henry Borger, said that Miller expected to be going to state prison following sentencing and hoped to receive treatment for drug and alcohol abuse there.

He asked the court to take into account that his client had taken responsibility for the offenses. “Mr. Miller has taken full responsibility for both of these offenses,” Borger said. “These were both serious charges and he pled to them.”

District Attorney Rob Greene asked that the sentences on the two charges run consecutively and that Miller have no direct nor indirect contact with the victim.

“You’ve caused a great deal of harm to this young girl,” Judge Gregory Hammond said. “This young girl has been significantly set back.”

“You’ve violated juvenile probation, adult probation or parole, on seven separate occasions,” Hammond said. “You were given numerous opportunities to address your addiction.”

“Consecutive state sentences are appropriate,” he said.

For sexual abuse of a child — child pornography, Miller was sentenced to 27 to 54 months in a state correctional institution with credit for 164 days served, court costs, $625 in fees, submit a DNA sample, complete a program for sexual offenders, and have no direct nor indirect contact with the victim.

For possession with intent to deliver, Miller was sentenced to 33 to 66 months in state prison, court costs, $475 in fees, complete a drug and alcohol evaluation and complete recommended treatment.

Hammond said Miller will also be under reentry supervision for 12 months after his release.
