Dispute nets man year in county jail

A Warren man will spend nearly a year in the county jail on terroristic threats and harassment charges stemming from an August domestic dispute.

Brian A.J. Henderson, 32, was sentenced by President Judge Maureen Skerda on Friday.

Henderson’s attorney, Assistant Public Defender Francis Waweru, said his client was apologetic and has taken responsibility for his conduct and is currently in treatment.

Waweru asked for a sentence that would include his client’s immediate release.

District Attorney Rob Greene said there is “absolutely no excuse for domestic violence” and said Handerson’s conduct “could have been a whole lot worse.

When he was charged, he also faced strangulation and simple assault charges that were not prosecuted in exchange for the plea.

Greene said Henderson threatened to kill and then attacked the victim and told the court that there are other violent criminal acts in Henderson’s history.

He asked for a state sentence for Henderson as he “doesn’t seem to be doing too well” in the county jail.

Henderson said he was “very sorry for what I did” and apologized to the victim for the “suffering and harm I’ve caused her.”

Skerda highlighted his conduct in the jail that included cheeking his medication, flooding his cell and a contraband violation that, she said, occurred because he was bored.

She asked about his mental health issues.

“I just have a problem controlling my anger,” he said, telling the court that he spit out his medications because they were watching a football playoff game in the jail and medication would have made him fall asleep too early.

He told the court he should have refused the medication but did take them and apologized to jail staff.

Skerda then sentenced him to 11.5 months to 23 months incarceration with credit for 172 days time served in the county jail, $350 in restitution, $1,425 in fines and fees, a no contact/no trespass order, work release and early reentry eligibility, submission of a DNA sample and to undergo mental health and anger management evaluations and comply with all recommendations on a count of terroristic threats as well as a $300 fine on a count of harassment.
