A Youngsville man will register as a sexual offender for life as the result of a sentence handed down Monday in connection with the sexual assault of a 6-year-old girl.

Jose A. Rodriguez, 29, was before President Judge Maureen Skerda for sentencing on a single count of indecent assault. Police records show that the victim told police that Rodriquez rubbed her chest, thighs, and stomach and also placed his hands under her clothes. His attorney, Public Defender Francis Waweru, told the court that his client does have a prior record but no other convictions of a sexual nature.

He told Skerda that his client has spent 403 days in the county jail and that the standard range for the charge is three months to 14 months incarceration. Waweru asked for a time served sentence for Rodriguez.

District Attorney Rob Greene first asked for a no contact/no trespass order for the victim and her family.

He argued that a state sentence would be most appropriate.

Rodriguez declined the opportunity to comment when given the opportunity to do so.

Skerda said she reviewed many things relating to this case from a Sexual Offender Assessment Board evaluation — which found Rodriguez is not a sexually violent predator — as well as the age of the victim, restitution summary and victim impact statement as well as his time spent in jail.

She then sentenced Rodriguez to 11 1/2 months to 23 months in the county jail with credit for 103 days time served. That is to be followed by three year probation. That probationary period will be followed by a mandated three year term of probation.

Fines and fees totaled $1,675 and he was ordered to complete 100 hours of community service and sexual offender counseling prior to being released from probation.

Skerda said the community service could not occur where minor children are present.

She also told him that he is “required to register for your entire life” as a Megan’s Law sexual offender.
