Federal WCSD mask case continued again

The Warren County School District has sought — and received — another continuance in federal court in the case that centers on the district’s end-around on state masking mandates.

A hearing on a preliminary injunction was scheduled for Tuesday at 10 a.m. at the federal courthouse in Erie.

That hearing has now been continued to next month.

And that’s if it happens at all.

“The parties,” the school district’s motion filed on Friday states, “have discussed resolution of the motion for preliminary injunction and the case, in whole.”

“In order to give the parties additional time to reach a possible resolution of the motion for preliminary injunction, the District requests that the Court continue the hearing” and brief deadline for seven days, the motion states.

U.S. District Judge Sarah Paradise Baxter granted the motion and continued the hearing to Nov. 22, well beyond the week requested.

A temporary restraint order had previously been granted by Judge Baxter that halted the district’s end-around effort.

Following that decision, the school board backed down, voting unanimously to rescind its attempts to circumvent the state guidance.
