Additional charges filed against man who struck officer
A man charged with striking a police officer with his car during the course of a September high-speed chase through Conewango, Pine Grove, and Elk townships, has had additional charges filed against him.
Devin W.M. Powell, 30, of Sugar Grove, was charged on Sept. 11 with aggravated assault, aggravated assault by vehicle while DUI, fleeing or attempting to elude officer, simple assault, recklessly endangering another person, DUI — controlled substance, possession of drug paraphernalia, accident involving damage to attended vehicle or property, and 26 summary driving violations.
He was taken to Warren County Jail after failing to post $250,000 bail.
The original case was withdrawn from the Warren County Court of Common Pleas and re-filed, with additional charges, in Magisterial District Court on Wednesday.
The additional counts are possession with intent to deliver controlled substances, possession of controlled substances, possession of a small amount of marijuana, and a second count of possession of drug paraphernalia.
According to the affidavit of probable cause, Powell led Conewango Township Police on a chase after he was observed shortly before 3 a.m. Saturday, Sept. 11, and recognized as having outstanding warrants for his arrest.
Powell reportedly sped north on Market Street, exceeding 100 miles per hour much of the way, until he turned right on Liberty Street, in Pine Grove Township, according to the affidavit. The chase moved onto Big Four Road and Conewango Avenue.
City of Warren Police and the Warren County chief detective were waiting at the intersection of Conewango and Hatch Run Road, according to the affidavit, and Powell pulled over.
According to the affidavit, a Conewango Township Police officer got out of his vehicle, with his weapon drawn, and ordered Powell to stop.
“Powell then turned around and drove at” the officer, and “struck (him) and his patrol unit with his vehicle,” according to the affidavit. After allegedly hitting the officer with his car, Powell “continued to flee from police.”
“He took numerous roads in Pine Grove and Elk townships while being pursued by multiple police vehicles,” according to the affidavit. “Powell then crashed into a tree on Hultberg Road in Elk Township. Powell attempted to flee on foot into the woods, but was apprehended.”
The Conewango Township Police officer who was struck by the vehicle was taken to Warren General Hospital for treatment. He was later released and “medically cleared for duty,” according to Chief Jason Peters.
The vehicle was impounded, according to police. Officers observed a clear wrapper with a white powdery substance inside in plain view in the vehicle.
Officers executed a search warrant on the vehicle on Oct. 21, finding four baggies containing was was suspected of being methamphetamine, a black plastic bag containing suspected marijuana, and drug paraphernalia, according to the affidavit.
