Sheffield man seeking post-sentence relief
A former Sheffield man imprisoned for decades after he threatened various Warren County court officials, is looking for post-sentence relief.
Jeremy C. Hoden, 30, is currently serving a sentence of 35 years and six months to 70 years at State Correctional Institution Phoenix, in Montgomery County.
At an August 2012 jury trial, Hoden and a co-defendant were found guilty of four counts of retaliation against judicial official; three counts of retaliation against witness or victim; one count of conspiracy — retaliation against judicial official; and seven counts of terroristic threats.
He was sentenced a month later to five to 10 years on each of the retaliation against official counts, including the conspiracy charge, and three-and-a-half to seven on each retaliation against witness or victim count. All sentences were ordered to be served consecutively.
That sentence was to begin at the conclusion of a previous sentence after Hoden entered a guilty plea in November of 2008 to charges of burglary, robbery, and theft. That sentence added up to 12 to 24 years.
According to a document mailed to the Times Observer, Hoden has asked for a new trial, the correction of his sentencing, and other relief including hearings, discovery, and the appointment of counsel.
He claims that evidence — a sworn letter from another inmate — that would have established that letters sent by Hoden and co-defendant Eddie Ray Gray were not retaliatory, but an escape attempt, was not heard at trial. He said that information was suppressed by the prosecution at the time of his 2012 trial.
Hoden said he became aware of the other inmate’s affidavit in October.
In June of 2019, Gray was resentenced after his convictions on the retaliation against witness or victim charges were overturned.
Gray received the same amount of time as the original sentences for the remaining charges — 25 to 50 years.
