Change of plea hearings

Eight defendants entered guilty pleas while bench warrants were issued for five more during change of plea proceedings on Thursday before Judge Gregory Hammond.

The following defendants pled guilty:

¯ Michael I. Barry, Russell, to possession with intent to deliver and criminal use of a communications facility. Charges of possession of a controlled substance and 11 counts of criminal use of a communication facility were not prosecuted.

¯ Donald J. Fink, Warren, to DUI: General impairment/incapable of safe driving – first offense and careless driving. Charges of DUI: Controlled substances/impaired ability – first offense, DUI: Controlled substance/Schedule I – first offense, DUI: Controlled substance/Schedule II or III, possession of drug paraphernalia and DUI: High rate of alcohol – first offense were not prosecuted.

¯ Tammy L. Furlow, Jamestown, NY, is conspiracy (possession with intent to deliver). Charges of possession of controlled substance, possession of drug paraphernalia and conspiracy (possession with intent to deliver) were not prosecuted.

¯ Shane M. Hurlburt, Kane, Pa., to conspiracy (possession with intent to deliver) A count of criminal use of a communications facility was not prosecuted.

¯ Matthew R. Kuzminski, Irvine, to charges at two dockets. At one, he pled guilty to theft by unlawful taking and criminal trespass while charges of burglary – not adapted for overnight and criminal mischief were not prosecuted. At a second docket, he pled guilty to criminal trespass and theft by unlawful taking and a count of burglary – overnight accommodation was not prosecuted.

¯ Shontrail Maye, Clarendon, to DUI: General impairment/incapable of safe driving – second offense, driving while under suspension and disorderly conduct. Charges of DUI: Highest rate of alcohol – second offense and DUI: Combined alcohol and drug or combination of drugs – second offense were not prosecuted.

¯ Zachary B. Miller, Warren, to possession of a controlled substance and driver required to be licensed. A count of driving while under suspension was not prosecuted.

¯ Christopher D. Morley, Warren, to contraband. A count of possession – small amount of marijuana was not prosecuted.

Bench warrants were issued for the following defendants for failure to appear:

¯ Johnathan J. Barnhill, Galivants Ferry, SC. Barnhill faces charges of DUI: General impairment/incapable of safe driving with accident – first offense, DUI: High rate of alcohol – first offense, driving an unregistered vehicle, driving on right side of roadway, prohibiting text-based communications and careless driving.

¯ Janelle M. Jones, Youngsville. Jones has been charged with DUI: Controlled substance/impaired ability – first offense, DUI: Controlled substance/Schedule II or III – first offense, DUI: Controlled substance/metabolite – first offense, driving while under suspension, driver required to be licensed, required financial responsibility, carrying and exhibiting driver’s license on demand and drive an unregistered vehicle.

¯ Elizabeth A. Klark, Warren. Klark has been charged with retail theft and conspiracy (retail theft).

¯ Justin E. Mueller, Pittsfield. Mueller has been charged with fleeing or attempting to elude police officer, DUI: General impairment/incapable of safe driving with accident – third offense, recklessly endangering another person, accident with damage to attended vehicle/property, driving while operating privilege is suspended/revoked, careless driving, stop signs and yield signs, driver required to be licensed, restriction on alcoholic beverages, reckless driving and general lighting requirements.

¯ Andrew J. Sipes, Lakewood, NY. Sipes has been charged with DUI: Controlled substance/Schedule II or III – first offense. DUI: Controlled substances/impaired ability – first offense, operation following suspension or registration, driving on roadways laned for traffic, driving vehicle at safe speed and careless driving.
