Thursday change of plea hearings

The following pleas were entered during formal arraignment and change of plea proceedings before Judge Gregory Hammond on Thursday at the Warren County Courthouse.

The following defendants pled guilty:

¯ Tyson I. McVey, Russell, to harassment. A count of stalking was not prosecuted. At a second docket, he pled guilty to DUI: General impairment/incapable of safe driving – first offense and reckless driving. Charges of DUI: Combined alcohol and drugs or combination of drugs, DUI: Highest rate of alcohol – first offense, DUI: Controlled substance – schedule I – first offense and careless driving were not prosecuted.

¯ Angel L. Phelps, Russell, to theft by unlawful taking.

The following defendants pled not guilty:

¯ Kevin M. Barnes, Kane. Barnes has been charged with DUI: Highest rate of alcohol – first offense and DUI: General impairment/incapable of safe driving – first offense.

¯ Johnny L. Crowley, Warren. Crowley has been charged with DUI: General impairment/incapable of safe driving – first offense, DUI: High rate of alcohol – first offense, driving without a license, turning movements and required signals, careless driving, no headlights, violate hazard regulation, restraint systems and operate vehicle without valid inspection.

¯ James D. Fazio, Corry. Fazio has been charged with possession with intent to deliver, two counts of possession of a controlled substance, possession of drug paraphernalia, DUI: Controlled substances – impaired ability – first offense, hinder apprehension/prosecution – harbor or conceal, driving while BAC .02 or greater while license suspended.

¯ Willard R. Fehlman, Sugar Grove. Fehlman has been charged DUI: General impairment/incapable of safe driving – first offense, flight to avoid apprehension/trial/punishment, obedience to traffic control devices, fail to keep right, driving at safe speed, depositing waste on highway, careless driving, fail to notify police of accident/damage to vehicle, violate hazard regulation, restraint systems and operate vehicle without valid inspection.

¯ Robert W. Haney, III, Warren. Haney has been charged with two counts of statutory sexual assault – 4-8 years older, aggravated indecent assault – complainant less than 18 years of age and corruption of minors.

¯ Casie J. Nichols, Jamestown, NY. Nichols has been charged with two counts each of forgery – unauthorized act in writing, access device issued to another who did not authorize use and theft by unlawful taking.

¯ Brandon M. Hostovich, Warren. Hostovich has been charged with DUI: Controlled substance/impaired ability – first offense, driving an unregistered vehicle and required financial responsibility.

¯ Natasha J. McGraw, Youngsville. McGraw has been charged with DUI: General impairment/incapable of safe driving – first offense, DUI: High rate of alcohol – first offense, duties at stop sign and careless driving.

¯ Katera E. Murphy, Russell. Murphy has been charged with retail theft, defiant trespass and smell/inhale toxic releasing substances.

¯ Andre J. Roche, Sheffield. Roche has been charged with DUI: General impairment/incapable of safe driving, DUI: Highest rate of alcohol – first offense, fail to carry license, careless driving and operate vehicle without valid inspection.
