Malys said she spoke with the victim in person and said the victim agreed with the Commonwealth.

Hammond asked if the victim was aware that the plea would result in all of the sexual offense charges not being prosecuted and Malys said she was.

Hammond then advised Lowman that the maximum penalty is 20 years incarceration and a fine of up to $25,000.

He said the conduct including using his size — approximately 390 pounds — “to stop the victim from breathing.”
