Criminal charges dropped for lack of DNA evidence
Sexual assault charges have been withdrawn against a Warren man due to a lack of DNA evidence.
District Attorney Rob Greene filed a motion to withdrawn criminal charges on Feb. 5 against Jason Michael Lee, 44, which included criminal attempt (rape unconscious victim), criminal attempt (sexual assault), criminal attempt (indecent assault), rape unconscious victim, sexual assault and indecent assault.
He was initially charged in March 2017 by Warren-based Pennsylvania State Police.
According to online court records, President Judge Maureen Skerda granted the motion a few days later.
“The Commonwealth believes that the newly discovered DNA evidence does not support the charges and exonerates the defendant,” Green’s motion states.
“There was other evidence that did support a conviction and I believe given the information that law enforcement had at the time of the complaint the actions taken by law enforcement were justified,” Greene told the Times Observer on Tuesday.
“As soon as we received the DNA evidence which could not be attributed to the defendant, I felt I could no longer prove the alleged criminal conduct beyond a reasonable doubt to a jury and therefore promptly dismissed the charges against the defendant,” Greene explained.
