Russell man to register as sex offender
A Russell man will have to register as a sexual offender as a result of having sexual contact with a 13-year-old female at Point Park in Warren.
According to court documents, Teddy William Luth Bair was charged in August with corruption of minors, unlawful contact with minor, indecent exposure and indecent assault person less than 16, stemming from an alleged May 1, 2016 incident.
He was sentenced on Friday on charges of indecent exposure and indecent assault by President Judge Maureen Skerda.
Bair’s attorney, Henry Borger, told the court that “in my 25 years of doing this, (Teddy) Bair is in the top five of the most remorseful people I’ve represented.”
Borger said that Bair knew what he did wasn’t right and gave him credit for stopping the incident before it became worse.
He told the court that Bair is in treatment, has extensively family reports and “certainly has a lot of love around him and support for him.”
District Attorney Rob Greene said that the victim’s family is not opposed to a probationary sentence but does want to see Bair continue in treatment.
He called the conduct “egregious” toward a “13-year-old little girl who had her body violated.”
“I’m sorry for my family, the courtroom (and) most importantly I’m sorry to the girl I did that to,” Bair said.
Skerda credited Borger for his thoroughness and added that a Sexual Offender Assessment Board evaluation found Bair not to be a sexually violent predator.
Skerda said Bair would be required to register with the Pennsylvania State Police as a sexual offender for the next 25 years.
State police reported that on Aug. 16, Warren/Forest Children and Youth Services contacted police regarding an interview with a 13-year-old victim that detailed a sexual interaction between the victim and Bair.
According to the affidavit, the victim had told Bair of her age and that she was in seventh grade at the time of the incident.
Police said Bair was interviewed on Aug. 21, at which time he told police that he had known the victim for a few years and that at the end of last school year in late spring he and (the victim) were “dating for a few weeks.”
Bair reportedly told police that he had picked up the victim at McDonalds in Warren and drove to Point Park where he and the victim were kissing against a tree. Police said Bair then detailed the same type of sexual contact described by the victim in the interview with CYS.
Police reported that Bair confirmed that he knew the victim’s age, but he “didn’t know until a later date that she was in seventh grade.”
According to the affidavit, “(Bair) continued that he could see another couple in the area, describing this as a reason he didn’t go any further” and “(Bair) stated he had been told by his parents not to be around younger females as it could lead to problems for him.”
Skerda sentenced Bair to two years probation, $1,175 in fines and fees, to have no contact with the victim, complete 50 hours of community service, attend a sexual offender program and submit a DNA sample on the indecent exposure charge. For indecent assault, he was sentenced to one year probation and an additional 50 hours of community service.
