Local meth case in hands of state Attorney General

A local meth case is likely now in the hands of the state Attorney General’s office due to a potential conflict for the District Attorney.

Marie Lynn Ecker, 38, 268 Main Street, Tidioute, faces two counts each of of possession of methamphetamine with intent to deliver, criminal use of a communication facility and possession of a controlled substance.

According to the affidavit of probable cause, Ecker, is alleged to have sold three Oxycodone pills on one date and was involved in the sale of an additional .90 grams of methamphetamine on another.

Her attorney, Elizabeth Feronti, had filed a motion for discovery that was before the court for argument on Friday.

Feronti said that District Attorney Rob Greene has turned the case over to the AG because a person named in the motion is Greene’s brother.

Assistant District Attorney Rick Hernan clarified the situation for Judge Gregory Hammond.

He said that Greene’s half-brother is a “close associate” of the defendants in these meth cases.

Hernan said the office initially wrote to the AG asking them to take the case but said that there was no clear definitive involvement by Daniel Greene at that time. In response, the AG declined to take the case.

However, Hernan explained that Feronti’s motion includes Daniel Greene as a potential co-conspirator in the case and, as a result, the DA’s office has again asked the AG to take over these meth cases.

He asked for a continuance to Feronti’s motion as the DA’s office has yet to hear back from the AG regarding whether or not they will accept the case.

Feronti didn’t object to a continuance which Hammond then approved.
