Warren man sent to state prison for over a year for fourth DUI

A Warren man will spend over one year in state prison for a fourth DUI conviction in 10 years.

Scott B. Curry, Warren, was sentenced on Friday by Judge Gregory Hammond on charges stemming from an incident on October 22 in Brokenstraw Twp.

Assistant Public Defender Nicholis Milardo acknowledged his client’s addiction problem but noted that Curry has attended all Alcoholic Anonymous and Narcotics Anonymous meetings available to him during his time in the Warren County Jail.

Assistant District Attorney Cody Brown pointed out that this was Curry’s fourth DUI in 10 years and sixth overall and noted that he “did have the benefit of Treatment Court” but was back before for the court for another DUI within three months of completing treatment court.

Curry apologized and said he was grateful that no one was hurt.

He said that he refused to give up or give in to alcoholism and said that his goal was to get back to his family.

Hammond said that Warren County has “put a lot of resources into helping you with your fight.” He reminded Curry that he had completed Treatment Court and said it was sad to see someone put in all the work to complete that program yet still pick up another DUI so soon.

“There is nothing more that can be done in the county system,” he concluded.

On a count of DUI: Highest rate of alcohol – fourth offense, Hammond sentenced Curry to 16 months to five years incarceration in a state correctional institution on a count of DUI: Highest rate of alcohol – fourth offense. He was fined $2,500, ordered to pay $875 in fees, to complete the alcohol highway safety school and victim impact panel programs and to undergo a drug and alcohol evaluation and subsequent treatment. His driver’s license was suspended for 18 months. Hammond ordered that he is boot camp and recidivism risk reduction incentive eligible.

He was sentenced to an additional consecutive 90 days in state prison, $1,000 fine and a 12 month driver’s license suspension on a count of driving with a BAC .02+ while license suspended. He was fined a total of $245 on a count of driving without a license, $345 and three month driver’s license and registration suspension as well as $70 for careless driving.
