Pleasantville man sent to state prison on theft, drug charges

One defendant was sentenced to state prison, 23 others were sentenced, and bench warrants were issued for three more, during Warren County Sentence Court proceedings Friday before Judge Maureen Skerda.

Ryan M. Young, 33, of Pleasantville, was sentenced to a total of 20 to 48 months in state correctional institution for theft from a motor vehicle and possession of a controlled substance. In explaining the state prison sentence, Skerda said, “I cannot see how I can impose the bottom end of the standard range because you’ve had so many opportunities.” She sentenced him to 14 to 36 months, boot camp and recidivism risk reduction incentive eligible, a $1,000 fine, $275 in fees, $504.28 in restitution, and no contact with the victim for theft; and six to 12 months to be served consecutively, a $100 fee, and a 12-month drivers license suspension, for possession.

Also sentenced were:

Brandon J. Albaugh, 26, of Warren, to 30 days in Warren County jail, 60 days of house arrest with electronic monitoring, and 57 months of probation, a $1,500 fine, $625 in fees, attend and pay for the county’s alcohol highway safety school and victim impact panel, drug and alcohol counseling, 18 month drivers license suspension, and 30 hours community service, for DUI: general impairment with refusal – second offense; and a $25 fine, and $45 fee, for operating vehicle without valid inspection.

Eric J. Anderson, 26, of Warren, to 60 days to two years minus one day in Warren County jail with credit for 16 days served, eligible for work release and early reentry, one year of consecutive probation, a $1,500 fine, and $975 in fees, for criminal conspiracy – possession with intent to deliver.

John E. Baran, 52, of Irvine, to one year of probation, a $350 fine, $275 in fees, 25 hours of community service, and an anger management evaluation, for resisting arrest.

Domingo Blume-Hearn, 19, of Warren, to six to 18 months in Warren County jail, to be served concurrent with an existing sentence, a $500 fine, $325 in fees, $150 in restitution, 150 hours of community service, and complete high school education, for theft by unlawful taking.

Melena S. Burry, 39, of Warren, to 178 to 356 days in Warren County jail with credit for 178 days served, a $400 fine, $325 in fees, an anger management evaluation, and maintain mental health regimen, for simple assault.

Brittany M. Chapman, 23, of Salamanca, N.Y., to 30 days to two years minus one day in Warren County jail, a $350 fine, a $150 fee, $1,007.34 in restitution, no contact with the victim, and 40 hours of community service, for receiving stolen property.

Jessi L. Coccaro, 34, of Sheffield, to one year of probation, a $600 fine, $275 in fees, no contact with the victim, 70 hours of community service, and maintain mental health regimen, for retail theft.

Frankie J. Davis, 37, of Erie, to 60 days in Warren County jail, four months of house arrest with electronic monitoring, 54 months of probation, $1,300 in fines, $700 in fees, attend and pay for the county’s alcohol highway safety school and victim impact panel, an 18-month drivers license suspension, 130 hours of community service, and continue with drug and alcohol counseling, for DUI: highest rate of alcohol – first offense; a $25 fine, and $45 fee, for driving on roadways laned for traffic; a $25 fine, and $45 fee, for turning movements and required signals, and a $25 fine, and $45 fee, for careless driving.

Azza M. Gaines, 36, of Chicora, to one year of probation, a $700 fine, $275 in fees, no contact with the victim, 30 hours of community service, and follow mental health regimen, for retail theft.

Sean F. Grimmer, 26, of Warren, to 96 hours to six months in Warren County jail with credit for four days served, a $1,000 fine, $625 in fees, attend and pay for the county’s alcohol highway safety school and victim impact panel, a 12-month drivers license suspension, and 15 hours community service, for DUI: highest rate of alcohol – first offense; and two years of consecutive probation, and $17,934.73 in restitution, for unauthorized use of automobile.

Melissa K. Horn, 47, of Pittsfield, to two years of probation, a $1,700 fine, $425 in fees, $1,909 in restitution, 225 hours of community service, and budget counseling, for fraud to obtain food stamps or assistance.

Jason E. Kennedy, 38, of Jamestown, N.Y., to two to 12 months in Warren County jail with credit for 201 days served, a $600 fine, $250 in fees, $552.94 in restitution, and no contact with the victim, for retail theft; and two to 11.5 months in Warren County jail, for criminal conspiracy – retail theft.

Brenda K. Knisley, 39, of Warren, to three to 12 months in Warren County jail concurrent to an existing sentence, a $750 fine, $250 in fees, $2,000 in restitution, no contact with the victim, and a mental health evaluation, for bad checks; and another concurrent 3 to 12 months in jail, an $800 fine, $425 in fees, $660.35 in restitution, no contact with the victim, and a mental health evaluation, for bad checks.

James W. Kuzminski, 55, of Russell, to 61 days to one year in Warren County jail with credit for 61 days served, a $1,100 fine, and $325 in fees, for disorderly conduct.

James L. Linger, 40, of Sherman, N.Y., to two years probation, a $600 fine, $300 in fees, and 75 hours of community service, for unsworn falsification to authorities.

David J. Martinelli, 21, of Sugar Grove, to 11.5 to 23 months in Warren County jail with credit for 138 days served, early reentry and work release eligible, a $2,500 fine, $550 in fees, $660 in restitution, and no contact with the victim, for theft by unlawful taking; three years of consecutive probation, for criminal conspiracy – criminal trespass; and a year of consecutive probation, for loitering and prowling at night.

Andrew L. Miles, 50, of Warren, to six to 12 months in Warren County jail, early reentry and work release eligible, with credit for 18 days served, a $500 fine, $325 in fees, no contact with the victim, and an anger management evaluation, for simple assault; and a consecutive 13 days to 12 months minus one day in Warren County jail with credit for 13 days served, a $1,100 fine, and $225 in fees, for disorderly conduct.

Tristin E. Pearson, 19, of Jamestown, N.Y., to 72 hours in Warren County jail, and the remainder of six months on probation, a $1,000 fine, $650 in fees, attend and pay for the county’s alcohol highway safety school and victim impact panel, a drug and alcohol evaluation, a 12-month drivers license suspension, and 15 hours of community service, for DUI: controlled substance – first offense; and a $25 fine, and $45 fee, for tire equipment and traction surfaces.

Rosalee A. Renninger, 49, of Russell, to 72 hours house arrest with electronic monitoring, the balance of six months on probation, a $1,000 fine, $375 in fees, attend and pay for the county’s alcohol highway safety school and victim impact panel, a drug and alcohol evaluation, a 12-month drivers license suspension, and 15 hours community service, for DUI: controlled substance – first offense; and two years of consecutive probation, a $350 fine, $275 in fees, and no contact with the victim, for retail theft.

Michael J. Shanshala, 77, of Warren, to 90 days house arrest with electronic monitoring, 57 months of probation, a $1,500 fine, $625 in fees, attend and pay for the county’s alcohol highway safety school and victim impact panel, an 18-month drivers license suspension, and 30 hours of community service, for DUI: general impairment with refusal – second offense; and a $25 fine, and a $45 fee, for driving on roadways laned for traffic.

Kari I. Stoneberg, 39, of DuBois, to one year of probation, a $350 fine, $275 in fees, no contact with the victim, 30 hours of community service, and maintain mental health regimen, for retail theft.

Benjamin E. Wilcox, 37, of Sugar Grove, to 30 days in Warren County jail, 11 months probation, a $700 fine, $525 in fees, no contact with the victim, a six-month drivers license suspension, 50 hours of community service, and continue drug and alcohol treatment, for possession of a controlled substance; and two years of probation, $279 in restitution, and 50 hours of community service, for theft by unlawful taking.

Brandon J. Wybiral, 23, of Sheffield, to two years of probation, a $500 fine, $425 in fees, 200 hours of community service, and an anger management evaluation, for simple assault.

Bench warrants were issued for the arrest of the following:

David A. Blakey, 26, of Jamestown, N.Y., to be sentenced for conspiracy – retail theft.

Raymond L. Lindsey, 57, of Warren, to be sentenced for DUI: highest rate of alcohol – first offense; careless driving; and failure to notify of address change.

Jacklyn M. Long, 27, of Jamestown, N.Y., to be sentenced for retail theft.

Edward C. Thornton, 37, of Warren, to be sentenced for possession of drug paraphernalia.
