Sentencing relief denied for Warren man
A Warren man who has been found in violation of several court orders was denied sentencing relief Friday.
Thomas Barbot-Aviles, 28, of Warren, remains in Warren County jail on repeated contempt charges following a denial of a sentence relief motion.
Judge Gregory Hammond denied the request and another to remove a no-contact condition from the sentence.
Hammond said he witnessed Barbot-Aviles attempting to intimidate the victim at a previous hearing in which the victim withdrew a protection-from-abuse order.
“The defendant cracked his knuckles while she was talking until I told him to knock it off,” Hammond said.
He said he informed Barbot-Aviles that, despite the withdrawal of the PFA, the no-contact condition from sentencing was still in effect following that hearing, but that Barbot-Aviles was found in contempt of his sentencing days later when he had contact with the victim.
While the defendant had the right to withdraw that order, Hammond said he did not believe changing the conditions of the sentence was appropriate.
“There’s no doubt in my mind Mr. Barbot-Aviles represents a threat to the victim,” Hammond said.
He detailed a “two-year marathon on abuse” that included, among others, “giving her black eyes, trying to drown her in a bathtub, threatening to have someone sexually assault her, and spitting in her face.”
“Continued contact is completely contrary to his rehabilitation,” he said and denied the motion.
