Warren man sentenced on child porn, drug charges
A Warren County man was sentenced to state prison on charges of child pornography and possession of a controlled substance with intent to deliver.
Austin J. Stuart, 25, of Warren, was sentenced to a total of 39 to 78 months in state prison, including 15 to 30 months, a $1,500 fine, fees of $675, court costs, and submit a DNA sample, for child pornography, and 24 to 48 months to be served consecutively, and a $100 fee, for possession with intent to deliver. He is not eligible for recidivism risk reduction incentive nor boot camp. He will be given preference for the state drug and alcohol treatment program while in prison.
Stuart is required to register as a Tier I sexual offender for 15 years, but was determined not to be a sexually violent predator.
“I take full responsibility for my actions,” Stuart said. “I have an extensive record — I caught really hard in the drug world.”
He said he sold drugs to support his habit. “I’m the only one that can take responsibility at the end of the day,” he said.
Because of his criminal history, including a previous charge of possession with intent to deliver, Assistant District Attorney Cody Brown asked that Stuart be sentenced in the aggravated range for that charge.
President Judge Maureen Skerda said she sentenced Stuart “at the bottom of the standard range” on the pornography charge and “at the high end of the standard range” on the drug charge.
