Sentence stands for Erie man charged with sex offense
What started out as a short county sentence back in 2019 has turned into years in state prison for an Erie man accused of sending sexually explicit material to a juvenile female.
An attempt to have that sentence reduced on Friday was rejected.
Cody C. Davis, 24, was initially sentenced to a minimum of two months incarceration and a total of four years probation back in 2019 on charges of obscene and other sexual materials as well as cyber harassment of a child.
According to the affidavit of probable cause, police received a complaint of a 20-year-old man sending pictures of his genitalia to a known 16-year-old female via SnapChat.
Upon checking the phone, police said they discovered “sexual content written by Davis as well as the two messages that included pictures of Davis’ genitals.”
Parole violations landed him back before the court last month, online court records show.
That’s when, according to First Assistant District Attorney Cody Brown, Davis was sentenced to 12-36 months incarceration in state prison.
Brown said during criminal argument Friday morning that Davis’ violations stem from additional sexual conduct — access to pornography that is not permitted.
He questioned, in light of that, whether Davis succeeded at treatment.
President Judge Maureen Skerda, who presided over the hearing Friday, said that she believes the sentence imposed was “appropriate” and denied the motion to reconsider.
