Sheffield woman sentenced to state prison
Judge Maureen Skerda handed down sentences on 19 defendants Friday during Warren County sentence court proceedings.
One defendant received a state prison sentence:
Crystal L. Lamere, Sheffield, to 15 to 30 months in a state correctional facility – boot camp eligible, a $1,500 fine, $675 in fees, court costs, a DNA sample, drug and alcohol evaluation and treatment, attend anger management program, and 60 hours of community service, for aggravated harassment by prisoner; and $300 fines for both harassment and disorderly conduct.
Others sentenced were:
Russell E. Bahneman, Pittsfield, to 10 months to two years less one day in Warren County jail – early re-entry and work release eligible, a $1,000 fine, $425 in fees, court costs, and 30 hours of community service for persons not to possess firearms.
Neftali Vellon Benitez, Jamestown, N.Y., to three months to two years less one day in Warren County jail – early re-entry and work release eligible, a $1,000 fine, $425 in fees, court costs, $1,096.80 in restitution, 40 hours of community service, and no contact with the victim, for retail theft.
Dustin F. Birchard, Warren, to 30 days in Warren County jail with credit for 30 days served – early re-entry and work release eligible, five months of probation, a $1,000 fine, $750 in fees, court costs, a 12-month drivers license suspension, and 15 hours of community service, for DUI: highest rate of alcohol – first offense; two years of probation to be served consecutively to the previous sentence, a $500 fine, a $45 surcharge, and another 12 months drivers license suspension, for fleeing or attempting to elude police officer; and a $200 fine, $45 surcharge, and another six months drivers license suspension, for reckless driving.
Curtis R. Hoffner, Youngsville, to 30 days in Warren County jail – work release and early re-entry eligible, five months probation, a $750 fine, $500 in fees, court costs, a 12-month drivers license suspension, attend, complete and pay for the Alcohol Highway Safety School and Victim Impact Panel, inpatient and outpatient substance treatment programs, and 15 hours of community service, for DUI: high rate of alcohol – second offense; and $25 fines, and $45 surcharges, for each of carrying and exhibiting drivers license on demand, driving vehicle at safe speed, and careless driving.
Travis M. Lyon, Pittsfield, to a $350 fine, $375 in fees, court costs, and a six-month drivers license suspension, for possession of drug paraphernalia.
James A. McDaniel, Russell, to 61 days to two years less one day in Warren County jail with credit for 61 days served, a $1,000 fine, $425 in fees, court costs, a drug and alcohol evaluation, the healthy relationships program, anger management, and 40 hours of community service, for simple assault.
Jamie L. Porter, Meadville, to 72 hours in Warren County jail, six months minus three days probation, a $1,000 fine, $625 in fees, court costs, attend, complete and pay for the Alcohol Highway Safety School and Victim Impact Panel, a 12-month drivers license suspension, and 15 hours community service, for DUI: highest rate of alcohol – first offense; an additional year of probation to be served consecutively, and 30 hours of community service, for unauthorized use of automobiles; a $200 fine, and $45 surcharge, for driver required to be licensed; and a $25 fine and $45 surcharge for both of driving on roadways laned for traffic and careless driving.
Kenndal Russell, Warren, to 60 days to one year in Warren County jail -eligible for immediate parole, a $350 fine, $125 in fees, court costs, a drug and alcohol evaluation, 40 hours of community service, and attend the cognitive rehabilitation program, for disorderly conduct.
Hunter R. Smith, Sheffield, to 90 days in Warren County jail, nine month of house arrest with electronic monitoring, and four years of probation, a $2,500 fine, $975 in fees, court costs, attend, complete, and pay for the Alcohol Highway Safety School and Victim Impact Panel, an 18-month drivers license suspension, and 30 hours of community service, for DUI: general impairment with accident – third; and 90 days of probation to be served concurrent to the previous sentence, and $300 in fees, for accident with damage to unattended property; and a $25 fine and $45 surcharge, for driving vehicle at safe speed.
Christa M. Sudul, Tidioute, to six days to one year in Warren County jail – eligible for immediate parole, an $800 fine, $275 in fees, court costs, and 50 hours of community service, for corruption of minors; a mental health evaluation and treatment, and two years of consecutive probation, attend the cognitive rehabilitation program, and 100 hours of community service, for a second count of corruption of minors.
Allison M. Turner, Jamestown, N.Y., to seven to 16 months in Warren County jail with credit for six days served, a $1,500 fine, $425 in fees, court costs, $2,250 in restitution, a drug and alcohol evaluation, no contact with the victim, a mental health evaluation, and 100 hours of community service, for theft by unlawful taking; and an additional year of probation for each of theft from a motor vehicle and access device fraud.
Thomas J. VanHouten, Warren, to three years of probation, a $1,100 fine, $425 in fees, court costs, no unsupervised contact with minors, no possession of a smartphone, sexual offender counseling, attend the cognitive rehabilitation program, and 70 hours of community service, for corruption of minors.
Amy S. Vibbert, Sugar Grove, to 90 days to two years less one day in Warren County jail with credit for 15 days served – early re-entry and work release eligible, a $500 fine, $375 in fees, court costs, and a mental health evaluation, for persons not to possess firearms.
Tracy A. Wadsworth, Randolph, N.Y., to three years probation, a $1,000 fine, $425 in fees, restitution of $1,147, court costs, no contact with the victim, and 50 hours community service, for retail theft; and three years of probation to be served consecutively with the previous sentence, a $1,000 fine, $425 in fees, $758.96 in restitution, no contact with the victim, and 50 hours community service, for a second count of retail theft.
Seth A. Weaver, Irvine, to 72 hours in Warren County jail, six months less three days of probation, a $1,000 fine, $825 in fees, court costs, attend, complete, and pay for the Alcohol Highway Safety School and Victim Impact Panel, a 12-month drivers license suspension, outpatient drug and alcohol counseling, fingerprinting, and 15 hours of community service, DUI: highest rate of alcohol – first offense; and a $25 fine and $45 surcharge, for careless driving.
Ashley M. Wojtkiewicz, Warren, to six days to two years less one day with credit for six days served, two years of probation, a $1,000 fine, $775 in fees, court costs, a drug and alcohol evaluation, six months drivers license suspension, a DNA sample, and 60 hours of community service, for possession with intent to deliver.
