Warren man arrested for alleged accidental shooting

A Warren man was jailed after shooting a woman in her home Wednesday morning.

The victim claims the shooting was accidental.

According to Pennsylvania State Police, Rodney L. Tomassoni, 48, of Warren, is charged with aggravated assault with a deadly weapon, discharging a firearm in an occupied structure, simple assault, and recklessly endangering another person.

In the affidavit of probable cause, police said Tomassoni and the victim had been out drinking, were arguing as they returned to the Cobham Park Road, Glade Township, residence, and got into a physical altercation.

“The defendant then went into ‘his office’ and retrieved the Ruger revolver, and was waving it around when it discharged,” the victim told police, according to the affidavit. “The victim stated she did not believe the defendant intentionally pointed the gun at her and did not intentionally shoot her.”

According to the affidavit, Tomassoni submitted to a test which indicated a 0.246 percent blood alcohol content.

Police did not question Tomassoni at the scene due to his condition. “The defendant was not questioned about the incident, though the defendant did state when asked where he was employed that, ‘I only remember putting chicken on her.'” Police found frozen chicken and frozen ground beef next to the seat where the victim was sitting when she was shot.

Police said the victim was shot in the lower, right hip.

The victim called 911 after 3:30 a.m. and was conscious and able to speak after the shooting, according to police, and was again conscious following surgery at UPMC Hamot, police said. No further condition update was available.

According to police, the gun misfired to some degree. “A clearing of the Ruger indicated the fired cartridge had splintered inside the gun cylinder with a piece of the discharged cartridge projectile located inside the cylinder,” police said. There were four unfired rounds in the gun.

Tomassoni was arraigned before District Justice Laura Bauer and taken to Warren County jail after failing to post $50,000.
