Defendants sentenced in county court

The following sentences were handed down by President Judge Maureen Skerda during sentence court proceedings on Friday at the Warren County Courthouse.

¯ Corey A. Ackley, Kane, to a five year intermediate punishment sentencing including 90 days incarceration and the duration on probation, $2,225 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, an 18 month license suspension and 30 hours of community service on a count of DUI: Highest rate of alcohol – second offense. Ackley is work release and early re-entry eligible.

¯ Katie S. Allen, Conneaut Lake, Pa., to a six month intermediate punishment sentence including five days incarceration and the duration on probation, $925 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, a 12 month license suspension, 15 hours of community service, credit for three days time served, to continue mental health and drug and alcohol recommendations on a count of DUI: General impairment – second offense. Allen is work release eligible.

¯ William C. Barhight, Sheffield, to 20 days to two years less one-day incarceration with credit for 20 days time served making him eligible for immediate parole, $775 in fines and fees, 30 hours of community service and mental health evaluation and compliance with recommendations on a count of terroristic threats.

¯ Nakota L. Bemis, Tidioute, to a three year intermediate punishment sentence including 90 days incarceration and the duration on probation with credit for nine days time served, $3,225 in fines and fees, a drug and alcohol evaluation and compliance with recommendations, 30 hours of community service, submission of a DNA sample, participation in the COG group on a count of conspiracy (possession phenylpropanolamine, etc.). Bemis is work release and early re-entry eligible. Bemis was sentenced to a consecutive year probation and 30 hours of community service on a count of possession of a controlled substance.

¯ Michael J. Bradish, Warren, to charges at three dockets. At one, he was sentenced to 15-60 months in state prison, $71,267.87 in restitution, $2,275 in fines and fees, completion of the alcohol highway safety school, a no contact/no trespass order, an 18 month license suspension, 30 hours of community service and priority for a therapeutic treatment community on a count of DUI: Combined alcohol/drugs or combination of drugs – second offense. He is boot camp and recidivism risk reduction incentive eligible and was given credit for 325 days time served. He was fined $70 each on charges of driving on roadways laned for traffic and careless driving. At a second docket, he was sentenced to six to 24 months incarceration in state prison, $1,225 in fines and fees, completion of the alcohol highway safety school, a 12 month license suspension, 45 hours of community service and priority for a therapeutic treatment community on a count of DUI: General impairment/incapable of safe driving – third offense. At a third docket, he was sentenced to 16 to 60 months incarceration in state prison, $5,761 in restitution, $3,425 in fines and fees, completion of the alcohol highway safety school, an 18-month license suspension, 60 hours of community service and priority for a therapeutic treatment community. He is boot camp and recidivism risk reduction incentive eligible. On a count of institutional vandalism, he was sentenced to an additional 30-60 days incarceration.

¯ Lorn R. Champlin, Sheffield, to 30 days to one-year incarceration in state prison and $875 in fines and fees on a count of furnishing drug-free urine. Champlin is boot camp and recidivism risk reduction incentive eligible.

¯ Lindsey M. Dale, Warren, to a six month intermediate punishment sentence including 30 days incarceration and credit for 16 days time served and the duration on probation, $1,550 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, 15 hours of community service, continuing with drug and alcohol treatment recommendations and work release and early re-entry eligibility on a count of DUI: Controlled substances – Schedule II or III – first offense. Dale was fined $70 each on charges of driving on roadways laned for traffic and careless driving.

¯ Brandon Gesaman, Ashville, NY, to a six month intermediate punishment sentence including 30 days on SCRAM electronic monitoring and the duration on probation, $1,250 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a count of DUI: High rate of alcohol – second offense.

¯ Suzanne V. Higgins, Tidioute, to a one year intermediate punishment sentence including 90 days incarceration with credit for 47 days time served and the duration on probation, $1,025 in fines and fees, 40 hours of community service, drug patch monitoring, participation in the COG program and compliance with drug and alcohol treatment recommendations on a count of possession of a controlled substance. Higgins is work release and early re-entry eligible and was sentenced to additional year probation on a count of furnishing drug-free urine.

¯ Gregory T. Joyner, Punxsutawney, Pa., to a six month intermediate punishment sentence with the entirety of it to be served as probation, $725 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a count of DUI: General impairment/incapable of safe driving – first offense. Joyner was fined $70 on a count of careless driving.

¯ Steven E. Kuzma, Corry, to a five year intermediate punishment sentence including 90 days house arrest with electronic monitoring and the duration on probation, $2,275 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, to undergo a drug and alcohol evaluation and comply with any recommendations, an 18 month license suspension and 30 hours of community service on a count of DUI: Controlled substance – Schedule I – second offense. He was fined $70 each on charges of driving on roadways laned for traffic and careless driving.

¯ Linda M. Lanyon, Corry, to a five year intermediate punishment sentence including 103 days incarceration with credit for 103 days time served and the duration on probation, $1,675 in fines and fees, to undergo a drug and alcohol evaluation and comply with recommendations, to participate in the COG program, submission of a DNA sample and 30 hours of community service on a count of conspiracy (possession with intent to deliver).

¯ James A. Little, Youngsville, to nine days to 18 months incarceration with credit for nine days time served making him eligible for immediate parole and the duration on probation, $900 in fines and fees, a no contact/no trespass order, 50 hours of community service and participation in the COG program on a count of unauthorized use of auto and other vehicles.

¯ Vincent J. Niedomys, Corry, to two years probation, $650 in fines and fees, a no contact/no trespass order, 30 hours of community service, a healthy relationships evaluation, an anger management evaluation and participation in the COG program on a count of simple assault.

¯ Jonathan D. Pieper, Warren, to a six month intermediate punishment sentence including 72 hours incarceration and the duration on probation, $2,125 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, a 12 month license suspension, 40 hours of community service and participation in a DUI intervention program on a count of DUI: Highest rate of alcohol – first offense.

¯ Matthew E. Powell, Conway, Pa., to a five year intermediate punishment sentence including 30 days incarceration, 60 days house arrest with electronic monitoring and the duration on probation, $2,150 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, an 18 month license suspension, 30 hours of community service and work release eligibility on a count of DUI: Highest rate of alcohol – second offense. He was fined $70 on a count of driving on roadways laned for traffic and $55 for a restraint system violation. The sentence is to be served in Beaver County.

¯ Andrew J. Proper, Warren, to a six month intermediate punishment sentence with 48 hours incarceration and up to 90 days with SCRAM electronic monitoring and the duration on probation, $1,300 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, a 12 month license suspension, 40 hours of community service and compliance with drug and alcohol recommendations on a count of DUI: General impairment/incapable of safe driving with accident – first offense. Proper is work release and early re-entry eligible. He was fined a total of $70 on a count of an improper right turn, $70 on a count of careless driving, $200 on a count of false reports and $70 on a count of operating vehicle without a valid inspection.

¯ Scott W. Slagle, Johnstown, Pa., to a five year intermediate punishment sentence including 175 days incarceration with credit for 175 days time served and the duration on probation, $2,275 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, an 18 month license suspension, 30 hours of community service and compliance with drug and alcohol recommendations on a count of DUI: Highest rate of alcohol – second offense. Slagle was sentenced to a concurrent year of probation and 30 hours of community service.
