Tidioute man sentenced for indecent assault
A Tidioute man will be required to register as a sexual offender for 15 years in the wake of a sentence handed down Friday in Warren County court.
Darrell L. Gesin, Jr., 26, was sentenced by President Judge Maureen Skerda on a single count of indecent assault.
Youngsville Borough police received a report back in May about indecent contact that allegedly occurred between Gesin and a 14-year-old female between December 2022 and January 2023, according to the affidavit of probable cause.
In interviews, the victim outlined three incidents of contact.
The first two allege that Gesin touched her leg before she was able to move away. The third time, though, he allegedly “unzipped her pants,” forcing the victim to get up and hid in the bathroom.
“When she came out of the bathroom,” the affidavit of probable cause states, “he apologized to her and stated he read things wrong.”
Gesin’s attorney, Assistant Public Defender Francis Waweru, told the court on Friday that his client has a very limited criminal record and asked for a sentence that did not include any jail time.
Assistant District Attorney Casey Strickland detailed the conduct.
“What happened with this victim is not OK,” she said, stating that it is something the victim will live with for the rest of her life.
Gesin apologized when given the opportunity to speak.
“I do understand what I did,” he said. “There does need to be some repercussions.”
Skerda noted that Gesin tested positive for marijuana and methamphetamine while on bail supervision.
“(There is) definitely some problem here,” she said.
Skerda then sentenced Gesin to three months to two years incarceration with credit for eight days time served, $1,400 in fines and fees, a no contact order with the victim or her family, to undergo drug and alcohol and mental health evaluations and comply with recommendations, submission of a DNA sample, 100 hours of community service and sexual offender counseling.
Skerda said that he would be required to register under Megan’s Law as a sexual offender for 15 years.
Two other individuals were sentenced Friday afternoon, as well:
Kevin S. Anderson, 36, Fayetteville, NC, to two months to two years incarceration with credit for 57 days time served, 80 hours of community service and $1,025 in fines and fees on a count of false reports to law enforcement.
Tyler P. Koller, 25, Painesville, Oh., to six months probation including 72 hours incarceration, credit for one day time served, participation in the alcohol highway safety school and victim impact panel programs, to undergo a drug and alcohol evaluation and comply with recommendations, a 12 month license suspension, $1,550 in fines and fees and 15 hours of community service on a count of DUI as well as $345 for operating a vehicle without required financial responsibility.
