Foiled theft lands two Warren men in jail

Two Warren men are behind bars and face robbery charges stemming from a Monday attempt – and subsequent failure – to steal drugs from a woman in downtown Warren.

Derrick Allen Shirley, 29, and Brandon Lee Shirley, 33, both of 413 Hickory St. are being held in the Warren County Jail on $75,000 bail on a charge of robbery – threat immediate serious injury.

They were arraigned by District Justice Todd Woodin on Tuesday morning.

Police were dispatched to the Kwik Fill on Hickory St. for a report “of a female that had been cut during a robbery.”

Police met the victim in this incident who said she was at 413 Hickory St and that Brandon Shirley and Derrick Shirley “attempted to steal her money.”

She “advised that Derrick Shirley had a baseball bat and (Brandon Shirley) had a knife,” the affidavit of probable cause against Brandon Shirley states. The victim “advised that Derrick Shirley ripped her cell phone out of her hand.”

In response, the victim told police that “she pulled a knife to defend herself” and “was able to get away from Derrick Shirley but then (Brandon Shirley) grabbed her and tried pulling her down the stairs by her bag.”

Police say that witnesses observed Brandon Shirley attempting to pull the victim down the stairs.

The two men were subsequently arrested and brought in for interviews.

Brandon Shirley was interviewed first and “stated that Derrick Shirley was attempting to steal drugs” from the victim and “advised that he pulled a knife and attempted to defend (the victim) from Derrick Shirley.”

Derrick Shirley gave police a different story.

He “advised that he and (Brandon Shirley) spoke an hour or two before (the victim) came home. Derrick Shirley advised they had knowledge that she had just went to get drugs so they planned on stealing it from her.

“Derrick Shirely advised that when he got home (the victim) was in the basement injecting meth into her neck” and “advised that he woke up (Brandon Shirley) and after a few minutes they carried out their plan to attempt to steal the drugs.”

Derrick Shirley continued to tell police, according to the affidavit, “that he grabbed a baseball bat in an attempt to intimidate (the victim) into giving them the drugs. Derrick Shirley advised that (the victim) pulled a knife which they didn’t plan for” and that the victim “threw a ‘nug’ – marijuana – and a little bit of meth at him and he was done at this point.

“Derrick Shirley advised that (Brandon Shirley) then grabbed the bag (the victim) was carrying in another attempt to steal the drugs. Derrick Shirley advised this was also a failed attempt.”
