Sentences handed down in court

President Judge Maureen Skerda handed down the following sentences during sentence court proceedings on Friday at the Warren County Courthouse.

¯ Joshua F. Benton, Warren, to one year probation, $650 in fines and fees, 40 hours of community service, submission of a DNA sample, outpatient mental health treatment and an anger management evaluation and compliance with recommendations on a count of simple assault — mutual consent fight.

¯ Laurel C. Falconer, Warren, six months probation, $725 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a count of DUI: General impairment/incapable of safe driving — first offense and $70 on a count of careless driving.

¯ Steven M. Klark, Pittsfield, to charges at two dockets. At one, Klark was sentenced to four months to eight months incarceration with credit for 120 days time served and immediate parole, two year probation, $1,127.31 in restitution, $1,675 in fines and fees, 80 hours of community service, a no trespass order at Walmart, participation in the COG program and compliance with drug and alcohol treatment recommendations on a count of conspiracy (retail theft) as well as 60 to 90 days incarceration with credit for 60 days time served, $545 in fines and fees, a one year license suspension and work release and early reentry eligibility on a count of driving license suspended. At a second docket, he was sentenced to 84 days to one year incarceration with credit for 84 days time served, $162 in restitution, $775 in fines and fees, a no contact/no trespass order, 40 hours of community service, work release and early reentry eligibility, participation in the COG program and compliance with drug and alcohol treatment on a count of receiving stolen property.

¯ Joseph R. Kuzminski, Pittsfield to six months to two years incarceration in state prison, $2,000 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, an 18 month license suspension and priority for drug and alcohol treatment in the state prison system on a count of DUI: Controlled substance/impaired ability — second offense as well as $70 each on charges of disregard traffic lane and careless driving.

¯ Lindsey P. Markey, Warren, to charges at four dockets. At one, Markey was sentenced to six months restrictive probation including 72 hours incarceration and 30 days house arrest with the duration on probation, $2,050 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, a 12 month license suspension, 15 hours of community service and work release eligibility on a count of DUI: Controlled substance — Schedule II or III — first offense. At a second docket, Markey was sentenced to five years restrictive probation including 30 days incarceration with credit for 30 days time served followed by inpatient drug and alcohol treatment and the duration on probation, $2,375 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, an 18 month license suspension, 30 hours of community service submission of a DNA sample and compliance with drug and alcohol treatment recommendations on a count of DUI: Controlled substance/impaired ability — second offense as well as one year probation and compliance with treatment recommendations on a count of possession of drug paraphernalia. At a third docket, Markey was sentenced to 47 days incarceration with credit for 47 days time served, $650 in restitution to Warren General Hospital and $475 in fines and fees on a count of criminal mischief — damage property and a $300 fine on a count of harassment. At a fourth docket, Markey was sentenced to one year probation, $600 in fines and fees and compliance with drug and alcohol treatment recommendations on a count of criminal attempt — theft by unlawful taking as well as one year concurrent probation each on charges of disorderly conduct — obscene language/gesture and resisting arrest.

¯ Justin E. Mueller, Pittsfield, to six months restrictive probation including five days incarceration and the duration on probation, $19,105 in restitution, $925 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, a 12 month license suspension, 30 hours of community service, outpatient drug and alcohol treatment and credit for time served on a count of DUI: General impairment/incapable of safe driving — second offense as well as four months incarceration and one year probation on a count of recklessly endangering person, 90 days incarceration, a $1,000 fine and a 12 month license suspension on a count of driving while license suspended while DUI and $70 each on charges of careless driving and duties at stop sign as well as $200 on a count of driving without a license.

¯ Jason E. Paden, Erie, to 19 days incarceration to two years less one day with credit for 19 days time served, one year probation, $1,450 in fines and fees, 70 hours of community service, submission of a DNA sample, participation in the COG program and anger management and/or healthy relationships evaluations and compliance with recommendations on a count of terroristic threats.

¯ Everett C. Walters, Warren, to five years restrictive probation, 90 days house arrest and the duration on probation, $2,575 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, an 18 month license suspension, submission of a DNA sample and 30 hours of community service on a count of DUI: Highest rate of alcohol — second offense and $70 on a count of careless driving.

¯ Donald E. Wester, Warren, to five years restrictive probation including 60 days incarceration and 30 days house arrest and the duration on probation, $2,375 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, to undergo a drug and alcohol evaluation and comply with recommendations, an 18 month license suspension, 30 hours of community service, work release eligibility and submission of a DNA sample on a count of DUI: Controlled substance/impaired ability — second offense and a total of $70 on a count of disregard traffic lane.

¯ Michele A. Wilson, Warren, to six months probation, $850 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs and 15 hours of community service on a count of DUI: General impairment/incapable of safe driving — first offense and $70 on a count of failure to stop at red signal.

A bench warrant was issued for the arrest of Benjamin J. Ernewein, Sugar Grove. Ernewein was to be sentenced on a count of disorderly conduct — engage in fighting.
