Guilty plea entered in assault case

A Bear Lake man who struck someone with the butt of a shotgun he was not permitted to possess, has entered a plea to simple assault and other charges.

Adam L. Smith, 35, of Bear Lake, entered a guilty plea to simple assault, terroristic threats, offensive weapons, harassment, disorderly conduct, and criminal mischief.

Charges including aggravated assault, terroristic threats, and harassment were not prosecuted.

According to Judge Gregory Hammond, who accepted the plea, Smith used racial epithets and profanity, had a Mossberg shotgun he was not permitted to have, threatened to knife a car belonging to the victim’s family, punched a victim in the face, threw a glass vase that hit a victim in the head, and pushed and struck a victim with the shotgun.

Hammond advised Smith of the maximum penalties for each of the charges to which he entered guilty pleas.

The aggregate maximum prison sentence was 14 years and 90 days and the maximum possible total fine was $30,300.

Restitution of $627 was requested.

Sentencing has not yet been scheduled.
