Defendants sentenced in county court

Judge Gregory Hammond handed down the following sentences on Friday morning at the Warren County Courthouse.

All periods of incarceration are to be served in the Warren County Jail unless otherwise specified.

¯ Ryan D. Baker, Jamestown, NY, to 95 days to two years less one day incarceration with credit for 95 days time served making him eligible for immediate parole, $894 in restitution, $1,125 in fines and fees, to undergo a drug and alcohol evaluation and comply with recommendations, 30 hours of community service, submission of a DNA sample and to not trespass on Walmart property on a count of retail theft as well as $245 and a 12-month license suspension on a count of driving while under suspension.

¯ Brooke M. Glienna, Sheffield, to 79 days to two years less one day incarceration with credit for 79 days time served making her eligible for immediate parole, $875 in fines and fees, drug and alcohol and mental health evaluations and compliance with recommendations and 30 hours of community service on a count of hindering apprehension/prosecution. At a second count of hindering apprehension/prosecution, she was sentenced to a consecutive year probation, $625 in fines and fees and 30 hours of community service.

¯ Elizabeth A. Klark, Warren, to two years probation, $564.72 in restitution, $925 in fines and fees, 30 hours of community service, submission of a DNA sample and not to trespass on Walmart property on a count of conspiracy (retail theft).

¯ Shontrail Maye, Clarendon, to a six-month intermediate punishment sentence including five days incarceration and the duration of probation, $675 in fines and fees, participation in the alcohol highway safety school and victim impact panel programs, a 12-month license suspension, 30 hours of community service and DUI: General impairment/incapable of safe driving – second offense; one-year consecutive probation, a $300 fine and 30 hours of community service on a count of disorderly conduct; $245 in fines and fees and a 12-month license suspension on a count of driving while under suspension.

¯ Christopher D. Morley, Warren, to a three-year intermediate punishment including a six-month restrictive portion to be served as four months at a residential recovery house followed by two months electronic monitoring and the duration of probation, $1,725 in fines and fees, 60 hours of community service, submission of a DNA sample and participation in AA and NA meetings, obtain a home group and sponsor and work a 12 step program on a count of contraband.

¯ Ralph R. Pratt, Jamestown, NY, to 12 months to 36 months in state prison with credit for 24 days time served, $251.75 in restitution, $1,625 in fines and fees, submission of a DNA sample and a no-trespass order at Tops on a count of criminal attempt (retail theft). He is not boot camp or recidivism risk reduction incentive eligible.

¯ Rodney L. Tomassoni, Warren, to six months to two years less one day incarceration with credit for 20 days time served, $1,000 in fines and fees, 30 hours of community service a mental health evaluation and compliance with mental health and drug and alcohol recommendations, work release and early re-entry eligibility and submission of a DNA sample on a count of recklessly endangering another person. He was sentenced to two years consecutive probation a $500 fine and 30 hours of community service on a count of simple assault.

Bench warrants were issued for failure to appear for the following defendants:

¯ Shane M. Hurlburt, Kane. Hurlburt was to be sentenced on a count of conspiracy (possession with intent to deliver).

¯ Janelle M. Jones, Warren. Jones was to be sentenced on charges of DUI: Controlled substance/impaired ability – first offense, driving while under suspension and required financial responsibility.
