Defendants sentenced in county court

President Judge Maureen Skerda handed down the following sentences during court proceedings on Friday morning at the Warren County Courthouse:

¯ Draven R. Anderson, Sheffield, to one-year probation, $550 in fines and fees, to undergo a drug and alcohol evaluation and comply with recommended treatment, a no-contact/no-trespass order, 30 hours of community service and participation in the COG program on a count of conspiracy (theft by unlawful taking). Anderson was also fined $150 on a count of defiant trespass.

¯ Katelyn P. Benton, Warren, to a six-month intermediate punishment sentence including five days incarceration and the duration of probation, $900 in fines and fees, participation in the victim impact panel and alcohol highway safety school programs, a 12-month license suspension, 30 hours of community service and drug and alcohol treatment unless not already completed on a count of DUI: General impairment/incapable of safe driving – second offense as well as $70 on a count of careless driving.

¯ David L. Bhe, Endeavor, Pa., to six months probation, $950 in fines and fees, participation in the victim impact panel and alcohol highway safety school programs, 45 hours of community service and participation in the DUI intervention program on a count of DUI: General impairment/incapable of safe driving – first offense and $70 each on charges of driving on right side of roadway and minimum speed regulation.

¯ Austin M. Brown, Warren, to 30 days to two years less one-day incarceration, $500 in restitution, $825 in fines and fees, a no-contact/no-trespass order, 70 hours of community service, work release and early reentry eligibility and participation in the COG program on a count of unauthorized used of automobile/other vehicles.

¯ Eric S. Conant, Titusville, to 16 days to one-year incarceration with credit for 16 days time served making him eligible for immediate parole, $575 in fines and fees, 40 hours of community service and participation in the COG program on a count of theft from a motor vehicle.

¯ Lissa M. Consbruck, Clarendon, to a six-month intermediate punishment including 48 hours incarceration and the duration of probation, $60.40 in restitution, $1,050 in fines and fees, participation in the victim impact panel and alcohol highway safety school programs, a 12-month license suspension, 15 hours of community service and drug and alcohol treatment on a count of DUI: General impairment/incapable of safe driving – first offense, $245 on a count of driver required to be licensed and an additional six months of probation, six-month license suspension and 20 hours of community service on a count of accident with damage to attended vehicle/property.

¯ Cody C. Davis, Erie, Pa., to two months to one-year incarceration with credit for two days time served, three years probation, $1,175 in fines and fees, a no-contact order with the victim or the victim’s family, 100 hours of community service, work release and early reentry eligibility, submission of a DNA sample, participation in the COG program and a sexual offender evaluation and any treatment recommended on a count of obscene and other sexual materials. Davis was also sentenced to one-year probation and 20 hours of community service on a count of cyber harassment of a child – seriously disparaging statements, etc.

¯ William J. Foley, Clarendon, to six months probation, $1,100 in fines and fees, participation in the victim impact panel and alcohol highway safety school programs, 60 hours of community service and participation in the DUI intervention program on a count of DUI: General impairment/incapable of safe driving – first offense. Foley was also fined $96 on a count of exceeding max speed limit established by 13 mph and $70 on a count of careless driving.

¯ Cody J. Garris, Warren, to 130 days incarceration to two years less one day with credit for 130 days time served making him eligible for immediate parole, $675 in fines and fees, 60 hours of community service, healthy relationships and anger management evaluations and compliance with any recommendations and participation in the COG program on a count of recklessly endangering another person in addition to $300 on a count of harassment.

¯ Gregory S. Havican, Erie, Pa., to three to 12 months incarceration, one-year probation, $405.53 in restitution, $1,550 in fines and fees, a no-contact/no-trespass order, 30 hours of community service, work release and early reentry eligibility, submission of a DNA sample and participation in the COG program on a count of theft by unlawful taking.

¯ David A. Larsen, Warren, to 30 days to one-year incarceration, $1,050 in fines and fees, a no-contact/no-trespass order, 50 hours of community service, work release and early reentry eligibility, submission of a DNA sample, a sexual offender evaluation and compliance with any recommendations and participation in the COG program on a count of simple assault. Larsen was sentenced to an additional two years probation and 50 hours of community service on a second count of simple assault.

¯ David A. Leonard, Warren, to one-year probation, $625 in fines and fees, to undergo a drug and alcohol evaluation and compliance with recommendations, 30 hours of community service and healthy relationships and anger management evaluations and compliance with recommendations on a count of disorderly conduct in addition to a $300 fine on a count of public drunkenness.

¯ Holly M. Lord, Youngsville, to one-year probation, $375 in fines and fees, 30 hours of community service, to undergo a mental health recommendation and comply with recommendations and participation in the COG program on a count of resisting arrest as well as one-year probation, to undergo a drug and alcohol evaluation and comply with recommendations and 30 hours of community service on a count of tamper with/fabricate physical evidence and $100 on a count of harassment. At a second docket, Lord was sentenced to six months probation, $350 in fines and fees, a no-contact order against three victims, to undergo a mental health evaluation and comply with recommendations and participation in the COG program on a count of open lewdness.

¯ Joshua Swartz, Sheffield, to one-year probation, $775 in fines and fees, submission of a DNA sample, to continue with a mental health regimen and to undergo an anger management evaluation and comply with recommendations on a count of simple assault.

¯ Alicia M. Toporzycki, Sheffield, to 12-24 months in state prison with credit for 197 days time served, $1,575 in fines and fees, a no-contact/communication order, submission of a DNA sample and priority for mental health programs in the state system on a count of simple assault. Toporzycki is boot camp but not recidivism risk reduction incentive eligible.

A bench warrant was issued for the arrest of Brenda Sullivan, Irvine, for failure to appear. Sullivan was to be sentenced on charges of DUI: Solvent or noxious substance – first offense and driving while under suspension.
