Sentences handed down in Warren Co. Court

The following defendants were sentenced on Friday by Judge Gregory Hammond.

All periods of incarceration are to be served in the Warren County Jail unless otherwise noted.

¯ Chet A. Anthony, Randolph, NY, to two years probation, $750 in fines and fees and 60 hours of community service on a count of terroristic threats. He was ordered to have no contact with the victim and not trespass on the victim’s property and to complete a healthy relationships program. On a count of defiant trespass, he was sentenced to a consecutive year of probation, a fine of $500 and 30 hours of community service.

¯ Jamie R. Bard, Mt. Jewett, Pa., to three months to one year incarceration, $1,625 in fines and fees, submission of a DNA sample and participation in drug and alcohol treatment on a count of access device fraud. He can only be paroled to an inpatient treatment center. He is work release eligible. On an additional count of access device fraud, he was sentenced to three to six months incarceration. On a third count of access device fraud, he was sentenced to 40 days to six months less one day incarceration. He was given credit for time served. He was also sentenced on eight separate counts of theft from a motor vehicle to one year of consecutive probation and restitution amounts on six of those charges at $416.46, $893.32, $840, $94.90, $105 and $150.

¯ Gary S. Below, Union City, to six months to one year incarceration in a state correctional facility on a count of criminal mischief – damage property. He was fined $500, ordered to pay $375 in fees and $1,900 in restitution. He was ordered to undergo a drug and alcohol evaluation and participate in any treatment recommended as well as a mental health evaluation and treatment. He is not boot camp or recidivism risk reduction incentive eligible but was given credit for time served. On an additional count of criminal mischief – damage property, he was sentenced to a consecutive six to 12 months in state prison, $1,841.16 in restitution, a fine of $500. He was ordered to have no contact with the victims or trespass on their property.

¯ Ehren Michael Brown, Warren, to six months to one year incarceration, $350 in restitution, fines and fees totaling $675 and 30 hours of community service. He was given credit for 127 days time served.

¯ George E. Drukenbrod, Jr., Tidioute, to a six month intermediate punishment sentence on a count of DUI: General impairment/incapable of safe driving – first offense to include 72 hours incarceration and the duration on general supervision. He was ordered to pay $1,425 in fines and fees, complete the alcohol highway safety school and victim impact panel programs and 15 hours of community service. His driver’s license was suspended for 12 months. He is work release eligible. On a count of required financial responsibility, he was fined a total of $345 and his driver’s license and vehicle registration were suspended for three months. He was ordered to pay $100 in restitution, a $300 fine and $45 in fees on a count of accidental damage to unattended vehicle/property.

¯ Edd Ferguson, Panama, NY, to a six month intermediate punishment sentence on a count of DUI: General impairment/incapable of safe driving – second offense to include five days incarceration and the rest on general supervision. He was ordered to pay $300 in restitution, $340 in fines and fees, to complete the alcohol highway safety school and victim impact panel programs, a 12 month driver’s license suspension and 30 hours of community service. He is work release eligible. On charges of fail to keep right and careless driving, he was fined a total of $70 each.

¯ Shonda R. Filiatrault, Warren, to two months to two years less one day house arrest on a count of theft by unlawful taking. She was ordered to pay a total of $875 in fines and fees and 30 hours of community service.

¯ Ralph Parks Haight III, Clarendon, to a five year intermediate punishment on a count of DUI: Highest rate of alcohol – first offense. The first 90 days will be served as house arrest with SCRAM monitoring and the duration will be served under general supervision. He was ordered to pay $1,975 in fines and fees, to complete the alcohol highway safety school and victim impact panel programs and to complete 100 hours of community service. He was ordered to continue with drug and alcohol treatment and his driver’s license was suspended for 18 months. He was fined a total of $70 on a count of careless driving.

¯ Lacy A. Honey, Warren, to 30 days to six months incarceration, $1,550 in fines and fees, to complete the alcohol highway safety school and victim impact panel, a 12 month driver’s license suspension, drug and alcohol treatment and 15 hours of community service on a count of DUI: Controlled substance – metabolite – first offense. She was fined $300 for possession of drug paraphernalia, $70 for careless driving and $345 plus three month license and vehicle registration suspensions on a count of required financial responsibility. She is work release and early re-entry eligible. At a second docket, she was sentenced to a five-year consecutive intermediate punishment to be served consecutively with 30 days incarceration to be followed by 60 days of house arrest with SCRAM monitoring on a count of DUI: Controlled substance – Schedule II or III – second offense. The duration will be served on general supervision. She was ordered to pay $2,000 in fines and fees, participate in drug and alcohol treatment as well as a mental health evaluation and treatment and her driver’s license was suspended for 18 months. On a count of endangering the welfare of a child, she was sentenced to six to 18 months less one day incarceration, a $1,000 fine, 30 hours of community service and was given credit for time served. She was fined a total of $70 on charges of fail to keep right and careless driving.

¯ Andrew J. Jordan, Jr., to 68 days to two years less one day incarceration with credit for 68 days time served making him eligible for immediate parole on a count of corruption of minors. He was ordered to pay $1,375 in fines and fees, to have no contact with the victim and to complete 60 hours of community service.

¯ Jeremiah R. Myers, Pittsfield, a total of four year probation – one year per count – on two counts each of corruption of minors and theft from a motor vehicle He was fined a total of $1,600, ordered to pay $500 in fees, have no contact with the victims in the case and complete 100 hours of community service.

¯ Ronald R. Rastetter, Union City, to 12 to 36 months in state prison on a count of criminal trespass – enter structure. He was ordered to pay $1,500 in fines and fees, have no contact with the victim and to submit a DNA sample. He was given credit for time served. On a count of theft of services, he was fined $300.

¯ Jesse James Salapek, Erie, to a six month intermediate punishment on a count of DUI: Highest rate – first offense. The first 72 hours are to be served as incarceration with the duration on general supervision. He was ordered to pay $1,650 in fines and fees, to complete the alcohol highway safety school and victim impact panel program as well as 15 hours of community service. He was ordered to continue with drug and alcohol treatment and his driver’s license was suspended for 15 months. He is work release eligible. He was fined a total of $70 on a count of careless driving.

¯ Jeanette A. Schock, Erie, to one day to one year incarceration and credit for one day time served making her eligible for immediate parole on a count of disorderly conduct. He was ordered to pay $425 in fines and fee, not trespass on the victim establishment’s property and to complete 25 hours of community service in addition to continuing with drug and alcohol treatment.

A bench warrant was issued for Tyler Lee McMaster, Bemus Point, NY, for failure to appear. McMaster was to be sentenced on charges of disorderly conduct – engage in fighting and DUI: Highest rate of alcohol – second offense.
